Russell National School Lunch Act to improve the efficiency of summer meals. Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Summer Meals Act 4 of 2019’’. 5 SEC. 2. SUMMER FOOD SERVICE PROGRAM FOR CHILDREN. 6 (a) BETTER INTEGRATE SUMMER EDUCATION AND 7 SUMMER MEALS PROGRAM.—Section 13(a)(1)(A)(i) of 8 the Richard B. Russell National School Lunch Act (42 9 U.S.C. 1761(a)(1)(A)(i)) (relating to the definition of the 10 VerDate Sep 11 2014 03:14 Jun 21, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1908.IS S1908 pamtmann on DSKBFK8HB2PROD with BILLS 2 •S 1908 IS term ‘‘area in which poor economic conditions exist’’) is 1 amended by striking ‘‘50 percent’’ each place it appears 2 and inserting ‘‘40 percent’’. 3 (b) REDUCE RED TAPE FOR PUBLIC-PRIVATE PART- 4 NERSHIPS.—Section 13(a)(8) of the Richard B. Russell 5 National School Lunch Act (42 U.S.C. 1761(a)(8)) is 6 amended— 7 (1) by striking the paragraph designation and 8 heading and all that follows through ‘‘Except’’ and 9 inserting the following: 10 ‘‘(8) YEAR-ROUND MEAL SERVICE.— 11 ‘‘(A) SEAMLESS SUMMER OPTION FOR 12 SCHOOLS.—Except’’; and 13 (2) by adding at the end the following: 14 ‘‘(B) YEAR-ROUND MEAL SERVICE FOR 15 OTHER SERVICE INSTITUTIONS.—Each service 16 institution (other than a service institution de- 17 scribed in subparagraph (A)), in addition to 18 being eligible for reimbursement for meals de- 19 scribed in subsection (b)(2) served during each 20 day of operation during the periods described in 21 subsection (c)(1), may be reimbursed for up to 22 1 meal and 1 snack per child served during 23 each day of operation during— 24 ‘‘(i) afterschool hours; 25 VerDate Sep 11 2014 03:14 Jun 21, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1908.IS S1908 pamtmann on DSKBFK8HB2PROD with BILLS 3 •S 1908 IS ‘‘(ii) weekends; and 1 ‘‘(iii) school holidays during the reg- 2 ular school calendar.’’. 3 (c) IMPROVE NUTRITION IN UNDERSERVED, HARD- 4 TO-REACH AREAS.—Section 13(a) of the Richard B. Rus- 5 sell National School Lunch Act (42 U.S.C. 1761(a)) is 6 amended— 7 (1) by striking paragraphs (9) and (10) and in- 8 serting the following: 9 ‘‘(9) IMPROVE NUTRITION IN UNDERSERVED, 10 HARD-TO-REACH AREAS.— 11 ‘‘(A) IN GENERAL.—Subject to the avail- 12 ability of appropriations provided in advance in 13 an appropriations Act specifically for the pur- 14 pose of carrying out this paragraph, the Sec- 15 retary shall award competitive grants to service 16 institutions selected by the Secretary to in- 17 crease participation in the program by children 18 who lack the ability to access a congregate feed- 19 ing site through— 20 ‘‘(i) innovative approaches to limited 21 transportation; 22 ‘‘(ii) mobile meal trucks; and 23 VerDate Sep 11 2014 03:14 Jun 21, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1908.IS S1908 pamtmann on DSKBFK8HB2PROD with BILLS 4 •S 1908 IS ‘‘(iii) any other method or approach 1 that does not require children to access a 2 congregate feeding site. 3 ‘‘(B) ELIGIBILITY.—To be selected to re- 4 ceive a grant under this paragraph, a service in- 5 stitution— 6 ‘‘(i) may be located in any State; and 7 ‘‘(ii) shall— 8 ‘‘(I) submit to the Secretary an 9 application at such time, in such man- 10 ner, and containing such information 11 as the Secretary may require; 12 ‘‘(II) meet criteria established by 13 the Secretary; and 14 ‘‘(III) agree to the terms and 15 conditions of the grant, as established 16 by the Secretary. 17 ‘‘(C) PRIORITY.—In awarding grants 18 under this paragraph, the Secretary shall give 19 priority to service institutions that plan— 20 ‘‘(i) to serve both breakfast and lunch; 21 or 22 ‘‘(ii) to serve lunch, a snack, and din- 23 ner. 24 VerDate Sep 11 2014 03:14 Jun 21, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1908.IS S1908 pamtmann on DSKBFK8HB2PROD with BILLS 5 •S 1908 IS ‘‘(D) TRAVEL REIMBURSEMENT.—A serv- 1 ice institution that receives a grant under sub- 2 paragraph (A)(i) may use grant funds to pro- 3 vide reimbursement for travel. 4 ‘‘(E) AUTHORIZATION OF APPROPRIA- 5 TIONS.—There is authorized to be appropriated 6 to the Secretary to make competitive grants 7 under this paragraph $10,000,000 for each fis- 8 cal year.’’; and 9 (2) by redesignating paragraphs (11) and (12) 10 as paragraphs (10) and (11), respectively. 11 (d) THIRD MEAL.—Section 13(b)(2) of the Richard 12 B. Russell National School Lunch Act (42 U.S.C. 13 1761(b)(2)) is amended by striking ‘‘only serve lunch’’ 14 and all that follows through ‘‘migrant children may’’. 15 (e) SUMMER MEAL SERVICE REIMBURSEMENT 16 AFTER EMERGENCIES AND DISASTERS.—Section 13 of 17 the Richard B. Russell National School Lunch Act (42 18 U.S.C. 1761) is amended by striking subsection (r) and 19 inserting the following: 20 ‘‘(r) SUMMER MEAL SERVICE REIMBURSEMENT 21 AFTER EMERGENCIES AND DISASTERS.— 22 ‘‘(1) DEFINITION OF AFFECTED AREA.—In this 23 subsection, the term ‘affected area’ means an area 24 for which— 25 VerDate Sep 11 2014 03:14 Jun 21, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S1908.IS S1908 pamtmann on DSKBFK8HB2PROD with BILLS 6 •S 1908 IS ‘‘(A) the President has declared a major 1 disaster in accordance with section 401 of the 2 Robert T. Stafford Disaster Relief and Emer- 3 gency Assistance Act (42 U.S.C. 5170); or 4 ‘‘(B) the Governor of the State in which 5 the area is located has declared an emergency 6 or disaster under State law. 7 ‘‘(2) SUMMER MEAL REIMBURSEMENT.—In an 8 affected area, the Secretary shall, on request by a 9 State, reimburse a service institution for meals pro- 10 vided under this section to children that consume 11 the meals by a noncongregate method or approach.’’. 12 (f) AUTHORIZATION OF APPROPRIATIONS.—Section 13 13 of the Richard B.
