bill; which was referred to the Committee on Energy and Commerce
A BILL
To require the Federal Communications Commission to pro-
vide evidence of certain robocall violations to the Attor-
ney General.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Locking Up
4
Robocallers Act of 2019’’.
5
SEC. 2. PROVISION OF EVIDENCE OF CERTAIN ROBOCALL
6
VIOLATIONS TO ATTORNEY GENERAL.

(a) IN GENERAL.—If the Chief of the Enforcement
8
Bureau of the Commission obtains evidence that suggests

a willful, knowing, and repeated robocall violation with an
1
intent to defraud, cause harm, or wrongfully obtain any-
2
thing of value, the Chief of the Enforcement Bureau shall
3
provide such evidence to the Attorney General.

(b) REPORT TO CONGRESS.—Not later than 1 year
5
after the date of the enactment of this Act, and annually
6
thereafter, the Commission shall publish on its website
7
and submit to the Committee on Energy and Commerce
8
of the House of Representatives and the Committee on
9
Commerce, Science, and Transportation of the Senate a
10
report that—
11
(1) states the number of instances during the
12
preceding year in which the Chief of the Enforce-
13
ment Bureau provided the evidence described in sub-
14
section (a) to the Attorney General; and
15
(2) contains a general summary of the types of
16
robocall violations to which such evidence relates.

(c) RULES OF CONSTRUCTION.—Nothing in this sec-
18
tion shall be construed to affect the ability of the Commis-
19
sion or the Chief of the Enforcement Bureau under other
20
law—
21
(1) to refer a matter to the Attorney General;
22
or
23
(2) to pursue or continue pursuit of an enforce-
24
ment action in a matter with respect to which the

Chief of the Enforcement Bureau provided the evi-

dence described in subsection (a) to the Attorney
2
General.

(d) DEFINITIONS.—In this section:
4
(1) COMMISSION.—The term ‘‘Commission’’
5
means the Federal Communications Commission.
6
(2) ROBOCALL VIOLATION.—The term ‘‘robocall
7
violation’’ means a violation of subsection (b) or (e)
8
of section 227 of the Communications Act of 1934
9
(47 U.S.C. 227).
