SHORT TITLE. 1 This Act may be cited as the ‘‘Blackwater Trading 2 Post Land Transfer Act’’. 3 SEC. 2. DEFINITIONS. 4 In this Act: 5 (1) BLACKWATER TRADING POST LAND.—The 6 term ‘‘Blackwater Trading Post Land’’ means the 7 approximately 55.3 acres of land as depicted on the 8 map that— 9 (A) is located in Pinal County, Arizona, 10 and bordered by Community land to the east, 11 west, and north and State Highway 87 to the 12 south; and 13 (B) is owned by the Community. 14 (2) COMMUNITY.—The term ‘‘Community’’ 15 means the Gila River Indian Community of the Res- 16 ervation. 17 (3) MAP.—The term ‘‘map’’ means the map en- 18 titled ‘‘Results of Survey, Ellis Property, A Portion 19 of the West 1⁄2 of Section 12, Township 5 South, 20 Range 7 East, Gila and Salt River Meridian, Pinal 21 County, Arizona’’ and dated October 15, 2012. 22 (4) RESERVATION.—The term ‘‘Reservation’’ 23 means the land located within the exterior bound- 24 aries of the reservation created under sections 3 and 25 4 of the Act of February 28, 1859 (11 Stat. 401, 26 VerDate Sep 11 2014 23:00 Jan 04, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3160.RDS H3160 kjohnson on DSK79L0C42PROD with BILLS 3 HR 3160 RDS chapter LXVI), and Executive orders of August 31, 1 1876, June 14, 1879, May 5, 1882, November 15, 2 1883, July 31, 1911, June 2, 1913, August 27, 3 1914, and July 19, 1915, and any other lands 4 placed in trust for the benefit of the Community. 5 (5) SECRETARY.—The term ‘‘Secretary’’ means 6 the Secretary of the Interior. 7 SEC. 3. LAND TAKEN INTO TRUST FOR BENEFIT OF THE 8 GILA RIVER INDIAN COMMUNITY. 9 (a) IN GENERAL.—The Secretary shall take the 10 Blackwater Trading Post land into trust for the benefit 11 of the Community, after the Community— 12 (1) conveys to the Secretary all right, title, and 13 interest of the Community in and to the Blackwater 14 Trading Post Land; 15 (2) submits to the Secretary a request to take 16 the Blackwater Trading Post Land into trust for the 17 benefit of the Community; 18 (3) conducts a survey (to the satisfaction of the 19 Secretary) to determine the exact acreage and legal 20 description of the Blackwater Trading Post Land, if 21 the Secretary determines a survey is necessary; and 22 (4) pays all costs of any survey conducted 23 under paragraph (3). 24 VerDate Sep 11 2014 23:00 Jan 04, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3160.RDS H3160 kjohnson on DSK79L0C42PROD with BILLS 4 HR 3160 RDS (b) AVAILABILITY OF MAP.—Not later than 180 days 1 after the Blackwater Trading Post Land is taken into 2 trust under subsection (a), the map shall be on file and 3 available for public inspection in the appropriate offices 4 of the Secretary. 5 (c) LANDS TAKEN INTO TRUST PART OF RESERVA- 6 TION.—After the date on which the Blackwater Trading 7 Post Land is taken into trust under subsection (a), the 8 land shall be treated as part of the Reservation. 9 (d) GAMING.—Class II and class III gaming under 10 the Indian Gaming Regulatory Act (25 U.S.C. 2701 et 11 seq.) shall not be allowed at any time on the land taken 12 into trust under subsection (a). 13 (e) DESCRIPTION.—Not later than 180 days after the 14 date of enactment of this Act, the Secretary shall cause 15 the full metes-and-bounds description of the Blackwater 16 Trading Post Land to be published in the Federal Reg- 17 ister.
