SHORT TITLE. 3 This Act may be cited as the ‘‘Land and Water Con- 4 servation Fund Permanent Funding Act’’. 5 SEC. 2. PERMANENT FULL FUNDING OF THE LAND AND 6 WATER CONSERVATION FUND. 7 (a) IN GENERAL.—Section 200303 of title 54, United 8 States Code, is amended to read as follows: 9 ‘‘§ 200303. Availability of funds 10 ‘‘(a) IN GENERAL.—For each fiscal year beginning 11 after the date of the enactment of this section, amounts de- 12 posited in the Fund under section 200302 shall be made 13 available for expenditure, without further appropriation or 14 fiscal year limitation, to carry out the purposes of the Fund 15 (including accounts and programs made available from the 16 Fund under the Consolidated and Further Continuing Ap- 17 propriations Act, 2015 (Public Law 113–235; 128 Stat. 18 2130)). 19 ‘‘(b) ADDITIONAL AMOUNTS.—Amounts made avail- 20 able under subsection (a) shall be in addition to amounts 21 made available to the Fund under section 105 of the Gulf 22 of Mexico Energy Security Act of 2006 (43 U.S.C. 1331 23 note; Public Law 109–432) or otherwise appropriated from 24 the Fund. 25 VerDate Sep 11 2014 21:23 Nov 08, 2019 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6203 E:\BILLS\H3195.RH H3195 pamtmann on DSKBC07HB2PROD with BILLS 6 •HR 3195 RH ‘‘(c) ALLOCATION AUTHORITY.— 1 ‘‘(1) SUBMISSION OF COST ESTIMATES.—The 2 President shall submit to Congress detailed account, 3 program, and project allocations to be funded under 4 subsection (a) as part of the annual budget submis- 5 sion of the President. 6 ‘‘(2) ALTERNATE ALLOCATION.— 7 ‘‘(A) IN GENERAL.—Appropriations Acts 8 may provide for alternate allocation of amounts 9 made available under subsection (a), including 10 allocations by account and program. 11 ‘‘(B) ALLOCATION BY PRESIDENT.— 12 ‘‘(i) NO ALTERNATE ALLOCATIONS.—If 13 Congress has not enacted legislation estab- 14 lishing alternate allocations by the date that 15 is 120 days after the date on which the ap- 16 plicable fiscal year begins, amounts made 17 available under subsection (a) shall be allo- 18 cated by the President. 19 ‘‘(ii) INSUFFICIENT ALTERNATE ALLO- 20 CATION.—If Congress enacts legislation es- 21 tablishing alternate allocations for amounts 22 made available under subsection (a) that 23 are less than the full amount appropriated 24 under that subsection, the difference between 25 VerDate Sep 11 2014 21:23 Nov 08, 2019 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6203 E:\BILLS\H3195.RH H3195 pamtmann on DSKBC07HB2PROD with BILLS 7 •HR 3195 RH the amount appropriated and the alternate 1 allocation shall be allocated by the Presi- 2 dent. 3 ‘‘(3) RECREATIONAL PUBLIC ACCESS.—Amounts 4 expended from the Fund under this section shall be 5 consistent with the requirements for recreational pub- 6 lic access for hunting, fishing, recreational shooting, 7 or other outdoor recreational purposes under section 8 200306(c). 9 ‘‘(4) ANNUAL REPORT.—The President shall sub- 10 mit to Congress an annual report that describes the 11 final allocation by account, program, and project of 12 amounts made available under subsection (a), includ- 13 ing a description of the status of obligations and ex- 14 penditures.’’. 15 (b) CONFORMING AMENDMENT.—Section 200302(c) of 16 title 54, United States Code, is amended by striking para- 17 graph (3). 18 (c) CLERICAL AMENDMENT.—The table of sections for 19 chapter 2003 of title 54, United States Code, is amended 20 by striking the item relating to section 200303 and insert- 21 ing the following: 22 ‘‘200303.
