PROHIBITION ON SALE OF INCLINED SLEEPERS 1 FOR INFANTS. 2 (a) PROHIBITION ON THE SALE OF INCLINED SLEEP- 3 ERS FOR INFANTS.—Beginning on the date that is 180 4 days after the date of enactment of this Act, it shall be 5 unlawful for any person to manufacture for sale, offer for 6 sale, distribute in commerce, or import into the United 7 States any inclined sleeper for infants. 8 (b) TREATMENT OF VIOLATION.—A violation of sub- 9 section (a) shall be treated as a violation of section 10 19(a)(1) of the Consumer Product Safety Act (15 U.S.C. 11 2068(a)(1)). 12 SEC. 3. FUTURE CPSC ACTION. 13 (a) IN GENERAL.—The Consumer Product Safety 14 Commission, in accordance with section 104 of the Con- 15 sumer Product Safety Improvement Act of 2008 (15 16 U.S.C. 2056a) may promulgate a consumer product safety 17 standard for a product category intended, marketed, or 18 designed to provide sleeping accommodations for an infant 19 up to one year old only if such standard is consistent with 20 safe sleep best practices as agreed upon by representatives 21 of consumer groups, nationally recognized organization 22 representing pediatricians, juvenile product manufactur- 23 ers, and independent child product engineers and experts. 24 (b) INTERPRETATION.—Nothing in this Act shall be 25 construed to prohibit the Consumer Product Safety Com- 26 VerDate Sep 11 2014 22:44 Jun 11, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1767.IS S1767 kjohnson on DSK79L0C42 with BILLS 3 •S 1767 IS mission from promulgating, in accordance with section 1 104 of the Consumer Product Safety Improvement Act of 2 2008 (15 U.S.C. 2056a), consumer product safety stand- 3 ards for products not intended, marketed or designed to 4 provide sleeping accommodations for an infant up to one 5 year old. 6 SEC. 4.
