A BILL
To amend title XIX of the Social Security Act and the
SUPPORT for Patients and Communities Act to ensure
health insurance coverage continuity for former foster
youth.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Expanded Coverage
4
for Former Foster Youth Act’’.

SEC. 2. COVERAGE CONTINUITY FOR FORMER FOSTER

CARE CHILDREN UP TO AGE 26.
2
(a) IN GENERAL.—Section 1002(a)(1)(B) of the
3
SUPPORT for Patients and Communities Act (Public
4
Law 115–271) is amended by striking all that follows
5
after ‘‘item (cc),’’ and inserting the following: ‘‘by striking
6
‘responsibility of the State’ and all that follows through
7
‘475(8)(B)(iii); and’ and inserting ‘responsibility of a
8
State on the date of attaining 18 years of age (or such
9
higher age as such State has elected under section
10
475(8)(B)(iii)), or who were in such care at any age but
11
subsequently left such care to enter into a legal guardian-
12
ship with a kinship caregiver (without regard to whether
13
kinship guardianship payments are being made on behalf
14
of the child under this part) or were emancipated from
15
such care prior to attaining age 18;’ ’’.

(b) AMENDMENTS TO SOCIAL SECURITY ACT.—

(1)
IN
GENERAL.—Section
18
1902(a)(10)(A)(i)(IX) of the Social Security Act (42
19
U.S.C. 1396a(a)(10)(A)(i)(IX)), as amended by sec-
20
tion 1002(a) of the SUPPORT for Patients and
21
Communities Act (Public Law 115–271), is amend-
22
ed—
23
(A) in item (bb), by striking the semicolon
24
at the end and inserting ‘‘; and’’; and
25
(B) by striking item (dd).

(2) EFFECTIVE DATE.—The amendments made
1
by this subsection shall take effect on January 1,
2
2023.

OUTREACH
EFFORTS
FOR
ENROLLMENT
OF
4
FORMER FOSTER CHILDREN.

Section 1902(a) of the Social Security Act (42 U.S.C.
6
1396a(a)) is amended—
7
(1) in paragraph (85), by striking ‘‘; and’’ and
8
inserting a semicolon;
9
(2) in paragraph (86), by striking the period at
10
the end and inserting ‘‘; and’’; and
11
(3) by inserting after paragraph (86) the fol-
12
lowing new paragraph:
13
‘‘(87) not later than January 1, 2020, establish
14
an outreach and enrollment program, in coordination
15
with the State agency responsible for administering
16
the State plan under part E of title IV and any
17
other appropriate or interested agencies, designed to
18
increase the enrollment of individuals who are eligi-
19
ble for medical assistance under the State plan
20
under paragraph (10)(A)(i)(IX) in accordance with
21
best practices established by the Secretary.’’.
