SHORT TITLE. 1 This Act may be cited as the ‘‘Promoting Physical 2 Activity for Americans Act’’. 3 SEC. 2. PHYSICAL ACTIVITY RECOMMENDATIONS FOR 4 AMERICANS. 5 (a) REPORTS.— 6 (1) IN GENERAL.—Not later than December 31, 7 2028, and at least every 10 years thereafter, the 8 Secretary of Health and Human Services (referred 9 to in this section as the ‘‘Secretary’’) shall publish 10 a report that provides physical activity recommenda- 11 tions for the people of the United States. Each such 12 report shall contain physical activity information and 13 recommendations for consideration and use by the 14 general public, and shall be considered, as applicable 15 and appropriate, by relevant Federal agencies in car- 16 rying out relevant Federal health programs. 17 (2) BASIS OF RECOMMENDATIONS.—The infor- 18 mation contained in each report required under 19 paragraph (1) shall be based on the most current 20 evidence-based scientific and medical knowledge at 21 the time the report is prepared, and shall include ad- 22 ditional recommendations for population subgroups, 23 such as children or individuals with disabilities, in- 24 cluding information regarding engagement in appro- 25 priate physical activity and avoiding inactivity. 26 VerDate Sep 11 2014 21:19 Dec 23, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1608.RFH S1608 pamtmann on DSKBC07HB2PROD with BILLS 3 S 1608 RFH (3) UPDATE REPORTS.—Not later than 5 years 1 after the publication of the first report under para- 2 graph (1), and at least every 10 years thereafter, the 3 Secretary shall publish an updated report detailing 4 evidence-based practices and highlighting continuing 5 issues with respect to physical activity. The contents 6 of reports under this paragraph may focus on a par- 7 ticular group, subsection, or other division of the 8 general public or on a particular issue relating to 9 physical activity. 10 (b) INTERACTION WITH OTHER RECOMMENDA- 11 TIONS.—Federal agencies proposing to issue physical ac- 12 tivity recommendations that differ from the recommenda- 13 tions in the most recent report published under subsection 14 (a)(1) shall, as applicable and appropriate, take into con- 15 sideration the recommendations provided through reports 16 issued under this Act. 17 (c) EXISTING AUTHORITY NOT AFFECTED.—This 18 section is not intended to limit the support of biomedical 19 research by any Federal agency or to limit the presen- 20 tation or communication of scientific or medical findings 21 or review of such findings by any Federal agency. 22 (d) LIMITATION.—Notwithstanding any other provi- 23 sion of this Act, no physical fitness standard established 24 VerDate Sep 11 2014 21:19 Dec 23, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1608.RFH S1608 pamtmann on DSKBC07HB2PROD with BILLS 4 S 1608 RFH under this Act shall be binding on any individual as a mat- 1 ter of Federal law or regulation. 2 Passed the Senate December 19, 2019.
