SHORT TITLE. 1 This Act may be cited as the ‘‘Protecting Faith- 2 Based and Nonprofit Organizations From Terrorism Act 3 of 2019’’. 4 SEC. 2. NONPROFIT SECURITY GRANT PROGRAM. 5 (a) IN GENERAL.—Subtitle A of title XX of the 6 Homeland Security Act of 2002 (6 U.S.C. 603 et seq.) 7 is amended by adding at the end the following: 8 ‘‘SEC. 2009. NONPROFIT SECURITY GRANT PROGRAM. 9 ‘‘(a) DEFINITION.—In this section, the term ‘eligible 10 nonprofit organization’ means an organization that is— 11 ‘‘(1) described in section 501(c)(3) of the Inter- 12 nal Revenue Code of 1986 and exempt from tax 13 under section 501(a) of such Code; and 14 ‘‘(2) determined to be at risk of a terrorist at- 15 tack by the Administrator. 16 ‘‘(b) ESTABLISHMENT.—There is established in the 17 Department a program to be known as the ‘Nonprofit Se- 18 curity Grant Program’, under which the Secretary, acting 19 through the Administrator, shall make grants to eligible 20 nonprofit organizations, through the State in which such 21 organizations are located, for target hardening and other 22 security enhancements to protect against terrorist attacks. 23 ‘‘(c) PERMITTED USES.—The recipient of a grant 24 under this section may use such grant for any of the fol- 25 lowing uses: 26 VerDate Sep 11 2014 22:12 Sep 10, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1539.RS S1539 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 1539 RS ‘‘(1) Target hardening activities, including 1 physical security enhancement equipment and in- 2 spection and screening systems. 3 ‘‘(2) Fees for security training relating to phys- 4 ical security and cybersecurity, target hardening, 5 terrorism awareness, and employee awareness. 6 ‘‘(3) Any other appropriate activity, including 7 cybersecurity resilience activities, as determined by 8 the Administrator. 9 ‘‘(d) PERIOD OF PERFORMANCE.—The Adminis- 10 trator shall make funds provided under this section avail- 11 able for use by a recipient of a grant for a period of not 12 less than 36 months. 13 ‘‘(e) REPORT.—The Administrator shall annually for 14 each of fiscal years 2020 through 2024 submit to the 15 Committee on Homeland Security and Governmental Af- 16 fairs of the Senate and the Committee on Homeland Secu- 17 rity of the House of Representatives a report containing 18 information on the expenditure by each recipient of grant 19 funds provided under this section. 20 ‘‘(f) AUTHORIZATION OF APPROPRIATIONS.— 21 ‘‘(1) IN GENERAL.—There is authorized to be 22 appropriated $75,000,000 for each of fiscal years 23 2020 through 2024 to carry out this section. 24 VerDate Sep 11 2014 22:12 Sep 10, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1539.RS S1539 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 1539 RS ‘‘(2) SPECIFICATION.—Of the amounts author- 1 ized to be appropriated pursuant to paragraph (1)— 2 ‘‘(A) $50,000,000 is authorized for eligible 3 nonprofit organizations located in jurisdictions 4 that receive funding under section 2003; and 5 ‘‘(B) $25,000,000 is authorized for eligible 6 nonprofit organizations located in jurisdictions 7 not receiving funding under section 2003.’’. 8 (b) CONFORMING AMENDMENT.—Section 2002(a) of 9 the Homeland Security Act of 2002 (6 U.S.C. 603(a)) is 10 amended by striking ‘‘sections 2003 and 2004’’ and in- 11 serting ‘‘sections 2003, 2004, and 2009’’. 12 (c) CLERICAL AMENDMENT.—The table of contents 13 in section 1(b) of the Homeland Security Act of 2002 is 14 amended by inserting after the item relating to section 15 2008 the following: 16 ‘‘Sec. 2009.
