ADDITIONS TO TOXICS RELEASE INVENTORY. 1 (a) DEFINITIONS.—In this section: 2 (1) ADMINISTRATOR.—The term ‘‘Adminis- 3 trator’’ means the Administrator of the Environ- 4 mental Protection Agency. 5 (2) TOXICS RELEASE INVENTORY.—The term 6 ‘‘toxics release inventory’’ means the toxics release 7 inventory under section 313(c) of the Emergency 8 Planning and Community Right-To-Know Act of 9 1986 (42 U.S.C. 11023(c)). 10 (b) IMMEDIATE INCLUSION.— 11 (1) IN GENERAL.—Subject to subsection (e), 12 beginning January 1 of the calendar year following 13 the date of enactment of this Act, the following 14 chemicals shall be deemed to be included in the 15 toxics release inventory: 16 (A) Perfluorooctanoic acid (commonly re- 17 ferred to as ‘‘PFOA’’) (Chemical Abstracts 18 Service No. 335–67–1). 19 (B) The salt associated with the chemical 20 described in subparagraph (A) (Chemical Ab- 21 stracts Service No. 3825–26–1). 22 (C) Perfluorooctane sulfonic acid (com- 23 monly referred to as ‘‘PFOS’’) (Chemical Ab- 24 stracts Service No. 1763–23–1). 25 VerDate Sep 11 2014 00:05 Jun 20, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6401 E:\BILLS\S1507.RS S1507 pamtmann on DSKBFK8HB2PROD with BILLS 3 •S 1507 RS (D) The salts associated with the chemical 1 described in subparagraph (C) (Chemical Ab- 2 stract Service Nos. 45298–90–6, 29457–72–5, 3 56773–42–3, 29081–56–9, 4021–47–0, 4 111873–33–7, and 91036–71–4). 5 (E) A perfluoroalkyl or polyfluoroalkyl sub- 6 stance or class of perfluoroalkyl or 7 polyfluoroalkyl substances that is— 8 (i) listed as an active chemical sub- 9 stance in the February 2019 update to the 10 inventory under section 8(b)(1) of the 11 Toxic Substances Control Act (15 U.S.C. 12 2607(b)(1)); and 13 (ii) on the date of enactment of this 14 Act, subject to the provisions of— 15 (I) section 721.9582 of title 40, 16 Code of Federal Regulations; or 17 (II) section 721.10536 of title 18 40, Code of Federal Regulations. 19 (2) THRESHOLD FOR REPORTING.— 20 (A) IN GENERAL.—Subject to subpara- 21 graph (B), the threshold for reporting the 22 chemicals described in paragraph (1) under sec- 23 tion 313(f)(1) of the Emergency Planning and 24 VerDate Sep 11 2014 00:05 Jun 20, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6401 E:\BILLS\S1507.RS S1507 pamtmann on DSKBFK8HB2PROD with BILLS 4 •S 1507 RS Community Right-To-Know Act of 1986 (42 1 U.S.C. 11023(f)(1)) is 100 pounds. 2 (B) REVISIONS.—Not later than 5 years 3 after the date of enactment of this Act, the Ad- 4 ministrator shall— 5 (i) determine whether revision of the 6 threshold under subparagraph (A) is war- 7 ranted; and 8 (ii) if the Administrator determines a 9 revision to be warranted under clause (i), 10 initiate a revision under section 313(f)(2) 11 of the Emergency Planning and Commu- 12 nity Right-To-Know Act of 1986 (42 13 U.S.C. 11023(f)(2)). 14 (c) INCLUSION FOLLOWING ASSESSMENT.— 15 (1) IN GENERAL.—Subject to subsection (e), a 16 perfluoroalkyl or polyfluoroalkyl substance or class 17 of perfluoroalkyl or polyfluoroalkyl substances shall 18 be automatically included in the toxics release inven- 19 tory beginning January 1 of the calendar year after 20 any of the following dates: 21 (A) ESTABLISHMENT OF TOXICITY 22 VALUE.—The date on which the Administrator 23 establishes a toxicity value for the 24 perfluoroalkyl or polyfluoroalkyl substance or 25 VerDate Sep 11 2014 00:05 Jun 20, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6401 E:\BILLS\S1507.RS S1507 pamtmann on DSKBFK8HB2PROD with BILLS 5 •S 1507 RS class of perfluoroalkyl or polyfluoroalkyl sub- 1 stances. 2 (B) SIGNIFICANT NEW USE RULE.—The 3 date on which the Administrator finalizes a sig- 4 nificant new use rule under subsection (a)(2) or 5 (f) of section 5 of the Toxic Substances Control 6 Act (15 U.S.C. 2604) for the perfluoroalkyl or 7 polyfluoroalkyl substance or class of 8 perfluoroalkyl or polyfluoroalkyl substances. 9 (C) ADDITION TO EXISTING SIGNIFICANT 10 NEW USE RULE.—The date on which the 11 perfluoroalkyl or polyfluoroalkyl substance or 12 class of perfluoroalkyl or polyfluoroalkyl sub- 13 stances is added to a list of substances covered 14 by a significant new use rule under subsection 15 (a)(2) or (f) of section 5 of the Toxic Sub- 16 stances Control Act (15 U.S.C. 2604). 17 (D) ADDITION AS ACTIVE CHEMICAL SUB- 18 STANCE.—The date on which the perfluoroalkyl 19 or polyfluoroalkyl substance or class of 20 perfluoroalkyl or polyfluoroalkyl substances that 21 is on a list of substances covered by a signifi- 22 cant new use rule under subsection (a)(2) or (f) 23 of section 5 of the Toxic Substances Control 24 Act (15 U.S.C. 2604) is added as an active 25 VerDate Sep 11 2014 00:05 Jun 20, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6401 E:\BILLS\S1507.RS S1507 pamtmann on DSKBFK8HB2PROD with BILLS 6 •S 1507 RS chemical substance on the inventory under sec- 1 tion 8(b)(1) of the Toxic Substances Control 2 Act (15 U.S.C. 2607(b)(1)). 3 (2) THRESHOLD FOR REPORTING.— 4 (A) IN GENERAL.—Subject to subpara- 5 graph (B), the threshold for reporting under 6 section 313(f)(1) of the Emergency Planning 7 and Community Right-To-Know Act of 1986 8 (42 U.S.C. 11203(f)(1)) the substances and 9 classes of substances included in the toxics re- 10 lease inventory under paragraph (1) is 100 11 pounds. 12 (B) REVISIONS.—Not later than 5 years 13 after the date of enactment of this Act, the Ad- 14 ministrator shall— 15 (i) determine whether revision of the 16 thresholds under subparagraph (A) is war- 17 ranted; and 18 (ii) if the Administrator determines a 19 revision to be warranted under clause (i), 20 initiate a revision under section 313(f)(2) 21 of the Emergency Planning and Commu- 22 nity Right-To-Know Act of 1986 (42 23 U.S.C. 11023(f)(2)). 24 (d) INCLUSION FOLLOWING DETERMINATION.— 25 VerDate Sep 11 2014 00:05 Jun 20, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6401 E:\BILLS\S1507.RS S1507 pamtmann on DSKBFK8HB2PROD with BILLS 7 •S 1507 RS (1) IN GENERAL.—To the extent not already 1 subject to subsection (b), not later than 2 years 2 after the date of enactment of this Act, the Adminis- 3 trator shall determine whether the substances and 4 classes of substances described in paragraph (2) 5 meet the criteria described in section 313(d)(2) of 6 the Emergency Planning and Community Right-To- 7 Know Act of 1986 (42 U.S.C. 11023(d)(2)) for in- 8 clusion in the toxics release inventory. 9 (2) SUBSTANCES DESCRIBED.—The substances 10 and classes of substances referred to in paragraph 11 (1) are perfluoroalkyl and polyfluoroalkyl substances 12 and classes of perfluoroalkyl and polyfluoroalkyl sub- 13 stances, including— 14 (A) hexafluoropropylene oxide dimer acid 15 (Chemical Abstracts Service No. 13252–13–6); 16 (B) the compounds associated with the 17 chemical described in subparagraph (A) (Chem- 18 ical Abstracts Service Nos. 62037–80–3 and 19 2062–98–8); 20 (C) perfluoro[(2-pentafluoroethoxy- 21 ethoxy)acetic acid] ammonium salt (Chemical 22 Abstracts Service No. 908020–52–0); 2 (M) perfluorohexanoic acid (Chemical Ab- 3 stracts Service No. 307–24–4); and 4 (N) a perfluoroalkyl and polyfluoroalkyl 5 substance or class of perfluoroalkyl or 6 polyfluoroalkyl substances other than those 7 chemicals described in subparagraphs (A) 8 through (M) that is used to manufacture 9 fluoropolymers, as determined by the Adminis- 10 trator. 11 (3) ADDITION TO TOXICS RELEASE INVEN- 12 TORY.—Subject to subsection (e), if the Adminis- 13 trator determines under paragraph (1) that a sub- 14 stance or a class of substances described in para- 15 graph (2) meets the criteria described in section 16 313(d)(2) of the Emergency Planning and Commu- 17 nity Right-To-Know Act of 1986 (42 U.S.C. 18 11023(d)(2)), the Administrator shall revise the 19 toxics release inventory to include that substance or 20 class of substances not later than 2 years after the 21 date on which the Administrator makes the deter- 22 mination. 23 (e) CONFIDENTIAL BUSINESS INFORMATION.— 24 VerDate Sep 11 2014 00:05 Jun 20, 2019 Jkt 089200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6401 E:\BILLS\S1507.RS S1507 pamtmann on DSKBFK8HB2PROD with BILLS 10 •S 1507 RS (1) IN GENERAL.—Prior to including on the 1 toxics release inventory pursuant to subsection 2 (b)(1), (c)(1), or (d)(3) any perfluoroalkyl or 3 polyfluoroalkyl substance or class of perfluoroalkyl 4 or polyfluoroalkyl substances the chemical identity of 5 which is subject to a claim of a person of protection 6 from disclosure under subsection (a) of section 552 7 of title 5, United States Code, pursuant to sub- 8 section (b)(4) of that section, the Administrator 9 shall— 10 (A) review that claim of protection from 11 disclosure; and 12 (B) require that person to reassert and 13 substantiate or resubstantiate that claim in ac- 14 cordance with section 14(f) of the Toxic Sub- 15 stances Control Act (15 U.S.C. 2613(f)). 16 (2) NONDISCLOSURE OF PROTECTION INFORMA- 17 TION.—If the Administrator determines that the 18 chemical identity of a perfluoroalkyl or 19 polyfluoroalkyl substance or class of perfluoroalkyl 20 or polyfluoroalkyl substances qualifies for protection 21 from disclosure under paragraph (1), the Adminis- 22 trator shall include the substance or class of sub- 23 stances, as applicable, on the toxics release inventory 24 VerDate Sep 11 2014 00:05 Jun 20, 2019 Jkt 089200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6401 E:\BILLS\S1507.RS S1507 pamtmann on DSKBFK8HB2PROD with BILLS 11 •S 1507 RS in a manner that does not disclose the protected in- 1 formation. 2 (f) EMERGENCY PLANNING AND COMMUNITY RIGHT- 3 TO-KNOW ACT OF 1986.—Section 313(c) of the Emer- 4 gency Planning and Community Right-To-Know Act of 5 1986 (42 U.S.C. 11023(c)) is amended— 6 (1) by striking the period at the end and insert- 7 ing ‘‘; and’’; 8 (2) by striking ‘‘are those chemicals’’ and in- 9 serting the following: ‘‘are— 10 ‘‘(1) the chemicals’’; and 11 (3) by adding at the end the following: 12 ‘‘(2) the chemicals included under subsections 13 (b)(1), (c)(1), and (d)(3) of section 2 of the PFAS 14 Release Disclosure Act.’’. 15 SECTION 1.
