A BILL
To amend title II of the Social Security Act to eliminate
the waiting periods for disability insurance benefits and
Medicare coverage for individuals with metastatic breast
cancer, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Metastatic Breast Can-
4
cer Access to Care Act’’.

SEC. 2. ELIMINATION OF WAITING PERIOD FOR INDIVID-
1
UALS WITH METASTATIC BREAST CANCER.

(a) IN GENERAL.—Section 223 of the Social Security
3
Act (42 U.S.C. 423) is amended—
4
(1) in subsection (a)—
5
(A) in paragraph (1), in the matter fol-
6
lowing subparagraph (E), by striking ‘‘or (ii)’’
7
and inserting ‘‘(ii) in the case of an individual
8
who has been medically determined to have
9
metastatic breast cancer, for each month begin-
10
ning with the first month during all of which
11
the individual is under a disability and in which
12
the individual becomes entitled to such insur-
13
ance benefits, or (iii)’’; and
14
(B) in paragraph (2)(B), by inserting ‘‘or
15
(iii)’’ after ‘‘clause (ii)’’.

(b) EFFECTIVE DATE.—The amendments made by
17
this section shall apply with respect to applications for dis-
18
ability insurance benefits filed after the date of the enact-
19
ment of this Act.

SEC. 3. WAIVER OF 24-MONTH WAITING PERIOD FOR MEDI-
21
CARE
COVERAGE
OF
INDIVIDUALS
WITH

METASTATIC BREAST CANCER.

(a) IN GENERAL.—Section 226(h) of the Social Secu-
24
rity Act (42 U.S.C. 426(h)) is amended by inserting ‘‘or
