To amend title 10, United States Code, to ensure that the final pay and
certificate of discharge or release for a reserve member of the Armed
Forces is ready upon discharge or release of that member from active
status.

Mr. PETERS (for himself and Mr. LANKFORD) introduced the following bill;
which was read twice and referred to the Committee on Armed Services
A BILL
To amend title 10, United States Code, to ensure that the
final pay and certificate of discharge or release for a
reserve member of the Armed Forces is ready upon dis-
charge or release of that member from active status.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Reserve Component
4
DD–214 Act of 2019’’.

SEC. 2. FINAL PAY AND CERTIFICATE OF DISCHARGE OR

RELEASE FOR RESERVE MEMBERS OF THE
2
ARMED FORCES UPON DISCHARGE OR RE-
3
LEASE FROM ACTIVE STATUS.

(a) IN GENERAL.—Section 1168(a) of title 10,
5
United States Code, is amended—
6
(1) by inserting ‘‘(1)’’ before ‘‘A member’’;
7
(2) by striking ‘‘an armed force’’ and inserting
8
‘‘the armed forces (including the reserve compo-
9
nents)’’;
10
(3) by inserting ‘‘or active status’’ after ‘‘active
11
duty’’ the first place it appears;
12
(4) by striking ‘‘his discharge certificate or cer-
13
tificate of release from active duty, respectively,’’
14
and inserting ‘‘the appropriate certificate’’;
15
(5) by striking ‘‘his final pay or a substantial
16
part of that pay,’’ and inserting ‘‘the final pay of the
17
member (or a substantial part of that pay)’’;
18
(6) by striking ‘‘him or his next of kin or legal
19
representative’’ and inserting ‘‘the member (or the
20
next of kin or legal representative of the member)’’;
21
and
22
(7) by adding at the end the following new
23
paragraphs:

‘‘(2) In paragraph (1), the term ‘appropriate certifi-
25
cate’ means the following:

‘‘(A) In the case of a member being discharged,

a discharge certificate.

‘‘(B) In the case of a member being released
3
from active duty, a certificate of release from active
4
duty.
5
‘‘(C) In the case of a member being released
6
from active status, a certificate of release from ac-
7
tive status.

‘‘(3) Any certificate of release from active status de-
9
livered pursuant to paragraph (1) with respect to a mem-
10
ber shall specify the total duration of inactive-duty train-
11
ing performed by the member during the period covered
12
by such certificate.’’.

(b) CONFORMING AMENDMENTS.—
14
(1) HEADING
AMENDMENT.—The heading of
15
such section is amended to read as follows:
16
‘‘§ 1168. Discharge or release from active duty or ac-
17
tive status: limitations’’.
18
(2) TABLE OF SECTIONS.—The table of sections
19
at the beginning of chapter 59 of such title is
20
amended by striking the item relating to section
21
1168 and inserting the following new item:

‘‘1168. Discharge or release from active duty or active status: limitations.’’.
