Ms. DUCKWORTH introduced the following bill; which was read twice and
referred to the Committee on Energy and Natural Resources
A BILL
To amend the Energy Reorganization Act of 1974 to clarify
whistleblower rights and protections, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Department of Energy
4
and Nuclear Regulatory Commission Whistleblower Pro-
5
tection Act of 2019’’.

SEC. 2. DEFINITION OF PERSON.
7
Section 211(a)(2) of the Energy Reorganization Act
8
of 1974 (42 U.S.C. 5851(a)(2)) is amended—

(1) by redesignating subparagraphs (A) through

(G) as clauses (i) through (vii), respectively, and in-

denting the clauses appropriately;

(2) in the matter preceding clause (i) (as so re-
4
designated), by striking the paragraph designation
5
and all that follows through ‘‘includes—’’ and insert-
6
ing the following:

‘‘(2) DEFINITIONS.—In this section:
8
‘‘(A) EMPLOYER.—The term ‘employer’ in-
9
cludes—’’; and
10
(3) by adding at the end the following:
11
‘‘(B) PERSON.—The term ‘person’ in-
12
cludes—

‘‘(i) a person (as defined in section 11
14
of the Atomic Energy Act of 1954 (42
15
U.S.C. 2014));
16
‘‘(ii) the Commission; and
17
‘‘(iii) the Department of Energy.’’.
