A BILL
To require the Secretary of the Interior to develop and
maintain a cadastre of Federal real property.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Federal Land Asset
4
Inventory Reform Act of 2019’’.
5
SEC. 2. CADASTRE OF FEDERAL REAL PROPERTY.
6
(a) DEFINITIONS.—In this section:
7
(1) CADASTRE.—
8
(A) IN
GENERAL.—The term ‘‘cadastre’’

means an inventory of real property developed

through collecting, storing, retrieving, or dis-

seminating graphical or digital data depicting
2
natural or man-made physical features, phe-
3
nomena, or boundaries of the earth, and any in-
4
formation related to the data, including—
5
(i) surveys;
6
(ii) maps;
7
(iii) charts;
8
(iv) satellite and airborne remote
9
sensing data;
10
(v) images; and
11
(vi) services of an architectural or en-
12
gineering nature performed by 1 or more
13
professionals, as authorized to perform the
14
services under State law, if applicable,
15
such as—
16
(I) a surveyor;
17
(II) a photogrammetrist;
18
(III) a hydrographer;
19
(IV) a geodesist; or
20
(V) a cartographer.
21
(B) INCLUSIONS.—The term ‘‘cadastre’’
22
includes—
23
(i) a reference frame consisting of a
24
current geodetic network that is consistent

with, and not duplicative of, the National
1
Geodic Survey of the National Oceanic and
2
Atmospheric Administration;
3
(ii) a series of current and accurate
4
large-scale maps;
5
(iii) an existing cadastral boundary
6
overlay delineating all cadastral parcels;
7
(iv) a system for indexing and identi-
8
fying each cadastral parcel; and
9
(v) a series of land data files, each in-
10
cluding the parcel identifier, which can be
11
used to retrieve information and cross-ref-
12
erence between and among other existing
13
data files that may contain information
14
about the use, assets, and infrastructure of
15
each parcel.

(2) DEPARTMENT.—The term ‘‘Department’’
17
means the Department of the Interior.
18
(3) FEDERAL
REAL
PROPERTY.—The term
19
‘‘Federal real property’’ means any real property
20
owned, leased, or otherwise managed by the Federal
21
Government.
22
(4) LANDHOLDING AGENCY.—The term ‘‘land-
23
holding agency’’ means a Federal department or

agency with statutory authority to control real prop-
1
erty.

(5) REAL
PROPERTY.—The term ‘‘real prop-
3
erty’’ means real estate consisting of—
4
(A) land;
5
(B) buildings, crops, forests, or other re-
6
sources still attached to or within the land;
7
(C) improvements or fixtures permanently
8
attached to the land;
9
(D) any structure on the land; or
10
(E) any interest, benefit, right, or privilege
11
in the property described in subparagraphs (A)
12
through (D).
13
(6) SECRETARY.—The term ‘‘Secretary’’ means
14
the Secretary of the Interior.

(b) CADASTRE OF FEDERAL REAL PROPERTY.—
16
(1) IN GENERAL.—The Secretary, in consulta-
17
tion with the heads of landholding agencies, shall de-
18
velop and maintain a current and accurate multipur-
19
pose cadastre of Federal real property and any real
20
property included under paragraph (2)(A) to support
21
Federal land management activities on Federal real
22
property, including—
23
(A) resource development and conserva-
24
tion;

(B) agricultural use;
1
(C) active forest management;
2
(D) environmental protection; and
3
(E) other use of the real property.

(2) COST-SHARING.—
5
(A) IN
GENERAL.—The Secretary may
6
enter into cost-sharing agreements with States
7
to include any non-Federal land in a State in
8
the cadastre under paragraph (1).
9
(B) COST SHARE.—The Federal share of
10
any cost-sharing agreement described in sub-
11
paragraph (A) shall not exceed 50 percent of
12
the total cost to a State for the development of
13
the cadastre of non-Federal land in the State.
14
(3) CONSOLIDATION AND REPORT.—Not later
15
than 180 days after the date of enactment of this
16
Act, the Secretary shall submit to the Committee on
17
Energy and Natural Resources of the Senate and
18
the Committee on Natural Resources of the House
19
of Representatives a report describing—
20
(A) the existing real property inventories
21
or any components of any cadastre of Federal
22
real property currently authorized by law or
23
maintained by the Department, including—

(i) the statutory authorization for
1
each existing real property inventory or
2
component of a cadastre; and
3
(ii) the amount expended by the Fed-
4
eral Government for each existing real
5
property inventory or component of a ca-
6
dastre in fiscal year 2018;
7
(B) the existing real property inventories
8
or any components of any cadastre of Federal
9
real property currently authorized by law or
10
maintained by the Department that will be
11
eliminated or consolidated into the multipurpose
12
cadastre under paragraph (1);
13
(C)(i) the existing real property inventories
14
or any components of any cadastre of Federal
15
real property currently authorized by law or
16
maintained by the Department that will not be
17
eliminated or consolidated into the multipurpose
18
cadastre under paragraph (1); and
19
(ii) a justification for not eliminating or
20
consolidating an existing real property inven-
21
tory or component of a cadastre described in
22
clause (i) into the multipurpose cadastre under
23
paragraph (1);

(D) the use of existing real property inven-
1
tories or any components of any cadastre cur-
2
rently maintained by any unit of State or local
3
government that can be used to identify Federal
4
real property within that unit of government;
5
(E) the cost-savings that will be achieved
6
by eliminating or consolidating duplicative or
7
unneeded real property inventories or any com-
8
ponents of any cadastre of Federal real prop-
9
erty currently authorized by law or maintained
10
by the Department that will become part of the
11
multipurpose cadastre under paragraph (1);
12
(F) a plan for the implementation of this
13
section, including a cost estimate and an assess-
14
ment of the feasibility of using revenue from
15
any transactional activity authorized by law to
16
offset any costs of implementing this section;
17
(G) an assessment described in subpara-
18
graphs (A) through (E) with regard to each ca-
19
dastre and inventory of Federal real property
20
authorized, operated, or maintained by each
21
other Federal agency, which shall be conducted
22
in consultation with the Director of the Office
23
of Management and Budget, the Administrator

of the General Services Administration, and the
1
Comptroller General of the United States; and
2
(H) recommendations for any legislation
3
necessary to increase the cost-savings and en-
4
hance the effectiveness and efficiency of replac-
5
ing, eliminating, or consolidating Federal real
6
property inventories or any components of any
7
cadastre of Federal real property currently au-
8
thorized by law or maintained by the Depart-
9
ment.
10
(4) COORDINATION.—In carrying out this sec-
11
tion, the Secretary shall—
12
(A) participate (in accordance with section
13
216 of the E-Government Act of 2002 (44
14
U.S.C. 3501 note; Public Law 107–347) and
15
section 757 of the Geospatial Data Act of 2018
16
(43 U.S.C. 2806) in the establishment of such
17
standards and common protocols as are nec-
18
essary
to
ensure
the
interoperability
of
19
geospatial information pertaining to the cadas-
20
tre under subsection (b)(1) for all users of the
21
information;
22
(B) coordinate with, seek assistance and
23
cooperation of, and provide liaison to the Fed-
24
eral Geographic Data Committee established by
25

section 753(a) of the Geospatial Data Act of
1
2018 (43 U.S.C. 2802(a)) for the implementa-
2
tion of and compliance with such standards and
3
requirements of that Act as may be applicable
4
to—
5
(i) the cadastre under subsection
6
(b)(1); and
7
(ii) any aspect of the development of
8
the cadastre under subsection (b)(1);
9
(C) integrate, or make the cadastre inter-
10
operable with, the Federal Real Property Pro-
11
file established pursuant to Executive Order
12
13327 (40 U.S.C. 121 note; relating to Federal
13
real property asset management); and
14
(D) to the maximum extent practicable, in-
15
tegrate with and leverage current cadastre ac-
16
tivities of units of State and local government.
17
(c) TRANSPARENCY AND PUBLIC ACCESS.—The Sec-
18
retary shall—
19
(1) in accordance with any requirements appli-
20
cable to the Department under section 759 of the
21
Geospatial Data Act of 2018 (43 U.S.C. 2808),
22
make the cadastre under subsection (b)(1) publicly
23
available on the internet—

(A) in a graphically geo-enabled and
1
searchable format; and
2
(B) in a manner that is consistent with,
3
and meets any requirements for integration
4
with, the GeoPlatform established under section
5
758(a) of that Act (43 U.S.C. 2807(a));
6
(2) ensure that the inventory referred to in sub-
7
section (b) includes the identification of all land suit-
8
able for disposal in accordance with the Federal
9
Land Policy and Management Act of 1976 (43
10
U.S.C. 1701 et seq.); and
11
(3) in consultation with the Secretary of De-
12
fense and the Secretary of Homeland Security, pre-
13
vent the disclosure of any parcel or parcels of land,
14
any buildings or facilities on the land, or any infor-
15
mation related to the land, buildings, or facilities if
16
that disclosure would impair or jeopardize the na-
17
tional security or homeland defense of the United
18
States.

(d) APPLICABLE LAW.—Any data that is part of the
20
cadastre developed under subsection (b)(1) shall be—
21
(1) considered to be geospatial data for pur-
22
poses of the Geospatial Data Act of 2018 (43 U.S.C.
23
2801 et seq.); and
24
(2) subject to the requirements of that Act.

(e) EFFECT.—Nothing in this section—
1
(1) creates any substantive or procedural right
2
or benefit; or
3
(2) requires or authorizes—
4
(A) any new surveying or mapping of Fed-
5
eral real property;
6
(B) the evaluation of any parcel of land or
7
other real property for potential management
8
by a non-Federal entity;
9
(C) the disposal of any Federal real prop-
10
erty; or
11
(D) any new appraisal or assessment of—
12
(i) the value of any parcel of Federal
13
land or other real property; or
14
(ii) the cultural and archaeological re-
15
sources on any parcel of Federal land or
16
other real property.
