Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. AUTHORITY TO CONDUCT INTERSTATE FIREARMS 1 TRANSACTIONS. 2 (a) FIREARMS DISPOSITIONS.—Section 922(b)(3)(A) 3 of title 18, United States Code, is amended— 4 (1) by striking ‘‘rifle or shotgun’’ and inserting 5 ‘‘firearm’’; 6 (2) by striking ‘‘located’’ and inserting ‘‘located 7 or temporarily located’’; and 8 (3) by striking ‘‘both such States’’ and insert- 9 ing ‘‘the State in which the transfer is conducted 10 and the State of residence of the transferee’’. 11 (b) DEALER LOCATION.—Section 923 of such title is 12 amended— 13 (1) in subsection (j)— 14 (A) in the first sentence, by striking ‘‘, and 15 such location is in the State which is specified 16 on the license’’; and 17 (B) in the last sentence— 18 (i) by inserting ‘‘transfer,’’ after 19 ‘‘sell,’’; and 20 (ii) by striking all that follows ‘‘Act’’ 21 and inserting a period; and 22 (2) by adding at the end the following: 23 ‘‘(m) Nothing in this chapter shall be construed to 24 prohibit the sale, transfer, delivery, or other disposition 25 of a firearm or ammunition— 26 VerDate Sep 11 2014 01:40 May 04, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2443.IH H2443 kjohnson on DSK79L0C42 with BILLS 3 •HR 2443 IH ‘‘(1) by a person licensed under this chapter to 1 another person so licensed, at any location in any 2 State; or 3 ‘‘(2) by a licensed importer, licensed manufac- 4 turer, or licensed dealer to a person not licensed 5 under this chapter, at a temporary location de- 6 scribed in subsection (j) in any State.’’. 7 (c) RESIDENCE OF UNITED STATES OFFICERS.— 8 Section 921 of such title is amended by striking subsection 9 (b) and inserting the following: 10 ‘‘(b) For purposes of this chapter: 11 ‘‘(1) A member of the Armed Forces on active 12 duty, or a spouse of the member, is a resident of— 13 ‘‘(A) the State in which the person main- 14 tains legal residence; 15 ‘‘(B) the State in which the permanent 16 duty station of the member is located; and 17 ‘‘(C) the State in which the member main- 18 tains a place of abode from which the member 19 commutes each day to the permanent duty sta- 20 tion. 21 ‘‘(2) An officer or employee of the United 22 States (other than a member of the Armed Forces) 23 stationed outside the United States for a period ex- 24 ceeding one year, or a spouse residing with such an 25 VerDate Sep 11 2014 01:40 May 04, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2443.IH H2443 kjohnson on DSK79L0C42 with BILLS 4 •HR 2443 IH officer or employee, is a resident of the State in 1 which the person maintains legal residence.’’. 2 Æ VerDate Sep 11 2014 01:40 May 04, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2443.IH H2443 kjohnson on DSK79L0C42 with BILLS
