To amend title XVIII of the Social Security Act to provide for the non-

tative wheelchairs and accessories.

A BILL
To amend title XVIII of the Social Security Act to provide
for the non-application of Medicare competitive acquisi-
tion rates to complex rehabilitative wheelchairs and ac-
cessories.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Protecting Beneficiary
4
Access to Complex Rehab Technology Act of 2019’’.

SEC. 2. CLARIFYING NON-APPLICATION OF MEDICARE

COMPETITIVE ACQUISITION RATES TO COM-

PLEX REHABILITATIVE WHEELCHAIRS AND

ACCESSORIES.

Section 1834(a)(1)(F) of the Social Security Act (42
5
U.S.C. 1395m(a)(1)(F)) is amended—
6
(1) in clause (ii), by striking at the end ‘‘and’’;
7
(2) in clause (iii), by striking at the end the pe-
8
riod and inserting ‘‘; and’’; and
9
(3) by adding at the end the following new
10
clause:

‘‘(iv) in the case of covered items fur-
12
nished on or after July 1, 2019, the Sec-
13
retary shall not apply this subparagraph or
14
any other provision of this title to use in-
15
formation from the competitive acquisition
16
program to determine payment amounts
17
for items excluded from such competitive
18
acquisition program, including all complex
19
rehabilitative manual and power wheel-
20
chairs classified by the Secretary as of
21
January 1, 2015, and, without limitation,
22
any wheelchair accessory, cushion, or back
23
when furnished in connection with a com-
