To amend the Homeland Security Act of 2002 to authorize provision to
a foreign government of financial assistance for foreign country oper-
ations to address individuals who may pose a national security, border
security, or terrorist threat to the United States before such a threat
reaches the United States, and for other purposes.

Mr. MCCAUL introduced the following bill; which was referred to the Com-
mittee on Foreign Affairs, and in addition to the Committee on Home-
land Security, for a period to be subsequently determined by the Speaker,
in each case for consideration of such provisions as fall within the juris-
diction of the committee concerned
A BILL
To amend the Homeland Security Act of 2002 to authorize
provision to a foreign government of financial assistance
for foreign country operations to address individuals who
may pose a national security, border security, or terrorist
threat to the United States before such a threat reaches
the United States, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Repatriation Assist-
2
ance Act of 2019’’.

SEC. 2. PROVISION OF HOMELAND SECURITY ASSISTANCE
4
TO FOREIGN GOVERNMENTS FOR CERTAIN
5
FOREIGN COUNTRY OPERATIONS.

(a) IN GENERAL.—Subtitle C of title IV of the
7
Homeland Security Act of 2002 (6 U.S.C. 231 et seq.)
8
is amended by adding at the end the following new section:

‘‘SEC. 437. HOMELAND SECURITY ASSISTANCE.
10
‘‘(a) IN GENERAL.—The Secretary, with the concur-
11
rence of the Secretary of State, may provide to a foreign
12
government financial assistance for foreign country oper-
13
ations to address individuals who may pose a national se-
14
curity, border security, or terrorist threat to the United
15
States before such a threat reaches the United States.
16
‘‘(b) DETERMINATION.—Assistance provided under
17
subsection (a) may be provided if such assistance would
18
enhance the recipient government’s capacity to mitigate
19
a threat described in such subsection, including through
20
related detention or removal operations by the recipient
21
government and procedures to screen and provide protec-
22
tion for certain individuals, as appropriate.

‘‘(c) REIMBURSEMENT
OF EXPENSES.—The Sec-
24
retary may, if appropriate, seek reimbursement from the

receiving foreign government for the provision of financial

assistance under this section.

‘‘(d) EFFECTIVE PERIOD.—The authority provided
3
under this section shall remain in effect until September
4
30, 2023.

‘‘(e) DEVELOPMENT AND PROGRAM EXECUTION.—
6
The Secretary and the Secretary of State shall jointly de-
7
velop and implement any financial assistance under this
8
section.
9
‘‘(f) RULE OF CONSTRUCTION.—Nothing in this sec-
10
tion may be construed as affecting, augmenting, or dimin-
11
ishing the authority of the Secretary of State.’’.
12
(b) CLERICAL AMENDMENT.—The table of contents
13
in section 1(b) of the Homeland Security Act of 2002 is
14
amended by striking the items relating to sections 435 and
15
436 and adding the following new items:

‘‘Sec. 435. Maritime operations coordination plan.
‘‘Sec. 436. Maritime security capabilities assessments.
‘‘Sec. 437. Homeland security assistance.’’.
