To require certain public housing agencies to absorb port-
in housing choice vouchers, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. REQUIRING CERTAIN PUBLIC HOUSING AGEN-
3
CIES TO ABSORB PORT-IN VOUCHERS.
4
Section 8(o) of the United States Housing Act of
5
1937 (42 U.S.C. 1437f(o)) is amended by adding at the
6
end the following:
7
‘‘(21) PORTABILITY OF VOUCHERS.—

‘‘(A) DEFINITIONS.—In this paragraph—

‘‘(i) the term ‘covered public housing
1
agency’ means a public housing agency
2
that, in a given fiscal year, utilizes less
3
than 95 percent of the budget authority
4
available to the public housing agency;
5
‘‘(ii) the term ‘initial public housing
6
agency’ has the meaning given the term
7
‘initial PHA’ in section 982.4 of title 24,
8
Code of Federal Regulations, or any suc-
9
cessor regulation; and
10
‘‘(iii) the term ‘portable family’ means
11
a family holding a voucher under this sub-
12
section that seeks to rent a dwelling unit
13
outside of the jurisdiction of the initial
14
public housing agency.

‘‘(B) REQUIREMENT.—A covered public
16
housing agency that has jurisdiction over the
17
area in which a portable family is seeking to
18
use the voucher received from an initial public
19
housing agency—
20
‘‘(i) shall be required to absorb and
21
receive the portable family by the end of
22
the calendar year in which the portable
23
family seeks to use the voucher;

‘‘(ii) shall make assistance payments

to the portable family under an annual
2
contributions contract entered into between
3
the covered public housing agency and the
4
Secretary; and
5
‘‘(iii) may not bill the initial public
6
housing agency for those assistance pay-
7
ments.’’.
