Ms. NORTON introduced the following bill; which was referred to the Com-
mittee on Natural Resources, and in addition to the Committee on Over-
sight and Reform, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall within
the jurisdiction of the committee concerned
A BILL
To convey the Robert F. Kennedy Memorial Stadium
Campus to the District of Columbia, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘RFK Memorial Sta-
4
dium Campus Conveyance Act’’.

SEC. 2. CONVEYANCE OF ROBERT F. KENNEDY MEMORIAL

STADIUM CAMPUS TO DISTRICT OF COLUM-
2
BIA.

(a) CONVEYANCE.—Subject to the requirements of
4
this section, the Secretary of the Interior shall convey all
5
right, title, and interest of the United States in and to
6
the Robert F. Kennedy Memorial Stadium Campus to the
7
District of Columbia.
8
(b) CONSIDERATION.—
9
(1) PAYMENT OF CONSIDERATION.—As consid-
10
eration for the conveyance under subsection (a), the
11
District of Columbia shall pay to the Secretary of
12
the Interior such amount as may be agreed to by the
13
District and the Secretary, except that the amount
14
may not be less than the fair market value of the
15
right, title, and interest conveyed under such sub-
16
section, based on an appraisal meeting the require-
17
ments of paragraph (2).

(2) REQUIREMENTS FOR APPRAISAL.—The re-
19
quirements for the appraisal described in paragraph
20
(1) are as follows:
21
(A) The appraisal is carried out by an ap-
22
praiser who is jointly selected by representatives
23
of both the Secretary and the District of Co-
24
lumbia.

(B) The appraisal is conducted in accord-
1
ance with the Uniform Appraisal Standards for
2
Federal Land Acquisitions and the Uniform
3
Standards of Professional Appraisal Practice.
4
(C) The appraisal is based on an assess-
5
ment of the property ‘‘As Is’’, as if the property
6
conveyed were vacant and unimproved as of the
7
date of the enactment of this Act, except that
8
the appraisal may take into account the terms
9
and conditions required under subsection (c).
10
(D) The appraisal takes into account any
11
costs associated with environmental remediation
12
and flood plain mitigation of the Robert F.
13
Kennedy Stadium Campus.
14
(E) The appraisal takes into account any
15
costs associated with the demolition of any ex-
16
isting structures on the Robert F. Kennedy Me-
17
morial Stadium Campus.
18
(3) TIMING OF PAYMENTS.—Not later than 30
19
days after the date of the conveyance under sub-
20
section (a), the District of Columbia shall pay to the
21
Secretary an amount equal to one-fourth of the
22
amount of the consideration determined under this
23
subsection, and shall pay the remaining balance in
24
equal amounts on the first day of each of the next

3 fiscal years which begin after the expiration of the
1
1-year period which begins on the date on which the
2
District makes the initial payment under this para-
3
graph.

(c) TERMS AND CONDITIONS.—
5
(1) CERTIFICATION REGARDING DEVELOPMENT
6
OF PROPERTY.—As a condition of the conveyance
7
under subsection (a), the District of Columbia shall
8
certify to the Secretary of the Interior prior to the
9
conveyance that the development or use of any prop-
10
erty conveyed under such subsection shall meet the
11
following requirements:
12
(A) The development or use shall not un-
13
dermine the restoration of the wetlands south
14
of Kingman Island.
15
(B) The development or use shall provide
16
for improved public access to the Anacostia
17
River including through walking trails and
18
kayak and canoe areas that complement the
19
Anacostia River Trail, and shall not interrupt
20
the design of the Anacostia River Trail.
21
(2) ADDITIONAL
TERMS
AND
CONDITIONS.—
22
The Secretary may require such additional terms
23
and conditions in connection with the conveyance
24
under subsection (a) as the Secretary considers ap-

propriate to protect the interests of the United
1
States.

(d) PAYMENT OF COSTS OF CONVEYANCE.—

(1) PAYMENT
REQUIRED.—The Secretary of
4
the Interior shall require the District of Columbia to
5
cover the costs to be incurred by the Secretary, or
6
to reimburse the Secretary for such costs incurred
7
by the Secretary, to carry out the conveyance under
8
subsection (a), including survey costs, costs for envi-
9
ronmental documentation, and any other administra-
10
tive costs related to the conveyance. If amounts are
11
collected from the District of Columbia in advance
12
of the Secretary incurring the actual costs, and the
13
amount collected exceeds the costs actually incurred
14
by the Secretary to carry out the conveyance, the
15
Secretary shall refund the excess amount to the Dis-
16
trict of Columbia.

(2) TREATMENT
OF
AMOUNTS
RECEIVED.—

Amounts received as reimbursement under para-
19
graph (1) shall be credited to the fund or account
20
that was used to cover those costs incurred by the
21
Secretary in carrying out the conveyance. Amounts
22
so credited shall be merged with amounts in such
23
fund or account, and shall be available for the same

purposes, and subject to the same conditions and
1
limitations, as amounts in such fund or account.

(e) DESCRIPTION OF PROPERTY.—The exact acreage
3
and legal description of the property to be exchanged
4
under this section shall be determined by surveys satisfac-
5
tory to the Secretary of the Interior.
6
(f) RULES OF CONSTRUCTION.—Nothing in this sec-
7
tion may be construed—
8
(1) to affect any obligations of the Secretary of
9
the Interior with respect to the Robert F. Kennedy
10
Memorial Stadium Campus under the National En-
11
vironmental Policy Act of 1969 (42 U.S.C. 4321 et
12
seq.) or the Comprehensive Environmental Re-
13
sponse, Compensation, and Liability Act of 1980 (42
14
U.S.C. 9601 et seq.); or
15
(2) to require the Secretary of the Interior to
16
pay any costs and expenses, other than costs and ex-
17
penses related to or associated with environmental li-
18
abilities or cleanup actions provided under law,
19
which are incurred by the District of Columbia or
20
any other party (other than the United States) at
21
any time in connection with carrying out this section
22
or the amendment made by this section.
23
(g) CONFORMING AMENDMENT.—Effective upon the
24
date of the conveyance under subsection (a), section 7 of

the District of Columbia Stadium Act of 1957 (sec. 3–
1
326, D.C. Official Code) is repealed.

(h) DEFINITION.—In this section, the term ‘‘Robert
3
F. Kennedy Memorial Stadium Campus’’ means such por-
4
tion of the Stadium, as defined in section 11 of the Dis-
5
trict of Columbia Stadium Act of 1957 (sec. 3–330, D.C.
6
Official Code), in which right, title, and interest is held
7
by the United States as of the date of the enactment of
8
this Act, as set forth in the Robert F. Kennedy Memorial
9
Stadium map produced by the National Park Service on
10
March 14, 2019.
