Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Small Business Devel- 4 opment Center Cyber Training Act of 2019’’. 5 SEC. 2. DUTIES OF SMALL BUSINESS DEVELOPMENT CEN- 6 TER COUNSELORS. 7 Section 21 of the Small Business Act (15 U.S.C. 648) 8 is amended by adding at the end the following: 9 VerDate Sep 11 2014 22:40 Jul 16, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1649.PCS H1649 pamtmann on DSKBFK8HB2PROD with BILLS 2 HR 1649 PCS ‘‘(o) CYBER STRATEGY TRAINING FOR SMALL BUSI- 1 NESS DEVELOPMENT CENTERS.— 2 ‘‘(1) DEFINITIONS.—In this subsection— 3 ‘‘(A) the term ‘cyber strategy’ means re- 4 sources and tactics to assist in planning for cy- 5 bersecurity and defending against cyber risks 6 and cyber attacks; and 7 ‘‘(B) the term ‘lead small business develop- 8 ment center’ means a small business develop- 9 ment center that has received a grant from the 10 Administration. 11 ‘‘(2) CERTIFICATION PROGRAM.—The Adminis- 12 trator shall establish a cyber counseling certification 13 program, or approve a similar existing program, to 14 certify the employees of lead small business develop- 15 ment centers to provide cyber planning assistance to 16 small business concerns. 17 ‘‘(3) NUMBER OF CERTIFIED EMPLOYEES.— 18 The Administrator shall ensure that the number of 19 employees of each lead small business development 20 center who are certified in providing cyber planning 21 assistance under this subsection is not fewer than 22 the lesser of— 23 ‘‘(A) 5; or 24 VerDate Sep 11 2014 22:40 Jul 16, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1649.PCS H1649 pamtmann on DSKBFK8HB2PROD with BILLS 3 HR 1649 PCS ‘‘(B) 10 percent of the total number of em- 1 ployees of the lead small business development 2 center. 3 ‘‘(4) CONSIDERATION OF SMALL BUSINESS DE- 4 VELOPMENT CENTER CYBER STRATEGY.—In car- 5 rying out this subsection, the Administrator, to the 6 extent practicable, shall consider any cyber strategy 7 methods included in the Small Business Develop- 8 ment Center Cyber Strategy developed under section 9 1841(a) of the National Defense Authorization Act 10 for Fiscal Year 2017 (Public Law 114–328; 130 11 Stat. 2662). 12 ‘‘(5) REIMBURSEMENT FOR CERTIFICATION.— 13 ‘‘(A) IN GENERAL.—Subject to the avail- 14 ability of appropriations and subparagraph (B), 15 the Administrator shall reimburse a lead small 16 business development center for costs relating 17 to the certification of an employee of the lead 18 small business development center under the 19 program established under paragraph (2). 20 ‘‘(B) LIMITATION.—The total amount re- 21 imbursed by the Administrator under subpara- 22 VerDate Sep 11 2014 22:40 Jul 16, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1649.PCS H1649 pamtmann on DSKBFK8HB2PROD with BILLS 4 HR 1649 PCS graph (A) may not exceed $350,000 in any fis- 1 cal year.’’. 2 Passed the House of Representatives July 15, 2019.
