Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘CBP Workload Staffing
4
Model Act’’.
5
SEC. 2. ESTABLISHMENT OF WORKLOAD STAFFING MODELS
6
FOR U.S. BORDER PATROL AND AIR AND MA-
7
RINE OPERATIONS OF CBP.
8
(a) IN GENERAL.—The Commissioner of U.S. Customs
9
and Border Protection shall in coordination with the Under
10
Secretary for Management, Chief Human Capital Officer,
11
and Chief Financial Officer of the Department of Homeland
12
Security, develop and implement, by not later than one
13
year after the date of the enactment of this Act, a workload
14
staffing model for each of the U.S. Border Patrol and Air
15
and Marine Operations.

(b) RESPONSIBILITIES
OF
THE COMMISSIONER
OF
17
CBP.—Subsection (c) of section 411 of the Homeland Secu-
18
rity Act of 2002 (6 U.S.C. 211) is amended—
19
(1) by redesignating paragraphs (18) and (19)
20
as paragraphs (20) and (21), respectively; and
21
(2) by inserting after paragraph (17) the fol-
22
lowing new paragraphs:

‘‘(18) implement a staffing model that includes
24
consideration for essential frontline operator activities

and functions, variations in operating environments,
1
present and planned infrastructure, present and
2
planned technology, and required operations support
3
levels for the U.S. Border Patrol, Air and Marine Op-
4
erations, and the Office of Field Operations, to man-
5
age and assign personnel of such entities to ensure
6
field and support posts possess adequate resources to
7
carry out duties specified in this section;
8
‘‘(19) develop standard operating procedures for
9
a workforce tracking system within the U.S. Border
10
Patrol, Air and Marine Operations, and the Office of
11
Field Operations, train the workforce of each of such
12
entities on the use, capabilities, and purpose of such
13
system, and implement internal controls to ensure
14
timely and accurate scheduling and reporting of ac-
15
tual completed work hours and activities;’’.

(c) REPORT.—Not later than one year after the date
17
of the enactment of this Act with respect to subsection (a)
18
and paragraphs (18) and (19) of section 411(c) of the
19
Homeland Security Act of 2002 (as amended by subsection
20
(b)), and annually thereafter with respect to such para-
21
graphs (18) and (19), the Secretary of Homeland Security
22
shall submit to the Committee on Homeland Security of the
23
House of Representatives and the Committee on Homeland
24
Security and Governmental Affairs of the Senate a status

update on the implementation of this Act and such para-
1
graphs (18) and (19), and status updates on such para-
2
graphs (18) and (19), as well as all relevant workload staff-
3
ing models. Such status updates shall include information
4
on data sources and methodology used to generate such
5
staffing models.

(d) INSPECTOR GENERAL REVIEW.—Not later than
7
120 days after the Commissioner of U.S. Customs and Bor-
8
der Protection develops a workload staffing model pursuant
9
to subsection (a), the Inspector General of the Department
10
of Homeland Security shall review such model and provide
11
feedback to the Secretary of Homeland Security and the
12
Committee on Homeland Security of the House of Rep-
13
resentatives and the Committee on Homeland Security and
14
Governmental Affairs of the Senate regarding the degree to
15
which such model is responsive to Inspector General rec-
16
ommendations, including recommendations from the In-
17
spector General’s February 2019 audit, and as appropriate,
18
any further recommendations to improve such model.
