Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SEMIAUTOMATIC RIFLE WITH CAPACITY TO AC- 1 CEPT DETACHABLE MAGAZINE TREATED AS 2 FIREARM UNDER NATIONAL FIREARMS ACT. 3 (a) IN GENERAL.—Section 5845(a) of the Internal 4 Revenue Code of 1986 is amended— 5 (1) by striking ‘‘; and (8) a destructive device.’’ 6 and inserting ‘‘; (8) a destructive device; and (9) a 7 semiautomatic rifle or shotgun that has the capacity 8 to accept a detachable ammunition feeding device.’’, 9 and 10 (2) by adding at the end the following: ‘‘The 11 term ‘detachable ammunition feeding device’ means 12 an ammunition feeding device that can be removed 13 from a firearm without disassembly of the firearm 14 action. The term ‘ammunition feeding device’ means 15 a magazine, belt, drum, feed strip, or similar device, 16 but does not include an attached tubular device 17 which is only capable of operating with .22 caliber 18 rimfire ammunition. The term ‘semiautomatic rifle 19 or shotgun’ means any repeating rifle or shotgun 20 which utilizes a portion of the energy of a firing car- 21 tridge to extract the fired cartridge case and cham- 22 ber the next round, and which requires a separate 23 pull of the trigger to fire each cartridge.’’ 24 (b) APPLICABILITY.—Any person who, on the date of 25 the enactment of this Act, lawfully owns or possesses a 26 VerDate Sep 11 2014 03:04 Feb 28, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1263.IH H1263 kjohnson on DSK79L0C42 with BILLS 3 •HR 1263 IH semiautomatic rifle or shotgun (as defined in section 1 5845(a) of such Code, as amended by this Act) that has 2 the capacity to accept a detachable ammunition feeding 3 device (as defined in such section) shall, not later than 4 120 days after the date of enactment of this Act, register 5 the semiautomatic rifle or shotgun in accordance with sec- 6 tion 5841 of such Code. Such registration shall become 7 a part of the National Firearms Registration and Transfer 8 Record required to be maintained by such section.
