SECTION 1. SHORT TITLE.

This Act may be cited as the ββSan Francisco Bay
2
Restoration Actββ.

SEC. 2. SAN FRANCISCO BAY RESTORATION GRANT PRO-
4
GRAM.

Title I of the Federal Water Pollution Control Act
6
(33 U.S.C. 1251 et seq.) is amended by adding at the end
7
the following:

ββSEC. 124. SAN FRANCISCO BAY RESTORATION GRANT PRO-
9
GRAM.
10
ββ(a) DEFINITIONS.βIn this section:
11
ββ(1) ESTUARY PARTNERSHIP.βThe term βEs-
12
tuary Partnershipβ means the San Francisco Estu-
13
ary Partnership, designated as the management con-
14
ference for the San Francisco Bay under section
15
320.

ββ(2) SAN
FRANCISCO

PLAN.βThe term
17
βSan Francisco Bay Planβ meansβ
18
ββ(A) until the date of the completion of the
19
plan developed by the Director under subsection
20
(d), the comprehensive conservation and man-
21
agement plan approved under section 320 for
22
the San Francisco Bay estuary; and
23
ββ(B) on and after the date of the comple-
24
tion of the plan developed by the Director under

subsection (d), the plan developed by the Direc-

tor under subsection (d).

ββ(b) PROGRAM OFFICE.β

ββ(1)
ESTABLISHMENT.βThe
Administrator
4
shall establish in the Environmental Protection
5
Agency a San Francisco Bay Program Office. The
6
Office shall be located at the headquarters of Region
7
9 of the Environmental Protection Agency.

ββ(2) APPOINTMENT
OF
DIRECTOR.βThe Ad-
9
ministrator shall appoint a Director of the Office,
10
who shall have management experience and technical
11
expertise relating to the San Francisco Bay and be
12
highly qualified to direct the development and imple-
13
mentation of projects, activities, and studies nec-
14
essary to implement the San Francisco Bay Plan.
15
ββ(3) DELEGATION OF AUTHORITY; STAFFING.β
16
The Administrator shall delegate to the Director
17
such authority and provide such staff as may be nec-
18
essary to carry out this section.
19
ββ(c) ANNUAL PRIORITY LIST.β
20
ββ(1) IN GENERAL.βAfter providing public no-
21
tice, the Director shall annually compile a priority
22
list, consistent with the San Francisco Bay Plan,
23
identifying and prioritizing the projects, activities,

and studies to be carried out with amounts made

available under subsection (e).

ββ(2) INCLUSIONS.βThe annual priority list
3
compiled under paragraph (1) shall include the fol-
4
lowing:
5
ββ(A) Projects, activities, and studies, in-
6
cluding restoration projects and habitat im-
7
provement for fish, waterfowl, and wildlife, that
8
advance the goals and objectives of the San
9
Francisco Bay Plan, forβ
10
ββ(i) water quality improvement, in-
11
cluding the reduction of marine litter;
12
ββ(ii) wetland, riverine, and estuary
13
restoration and protection;
14
ββ(iii) nearshore and endangered spe-
15
cies recovery; and
16
ββ(iv) adaptation to climate change.
17
ββ(B) Information on the projects, activi-
18
ties, and studies specified under subparagraph
19
(A), includingβ
20
ββ(i) the identity of each entity receiv-
21
ing assistance pursuant to subsection (e);
22
and
23
ββ(ii) a description of the communities
24
to be served.

ββ(C) The criteria and methods established
1
by the Director for identification of projects, ac-
2
tivities, and studies to be included on the an-
3
nual priority list.

ββ(3) CONSULTATION.βIn compiling the annual
5
priority list under paragraph (1), the Director shall
6
consult with, and consider the recommendations ofβ
7
ββ(A) the Estuary Partnership;
8
ββ(B) the State of California and affected
9
local governments in the San Francisco Bay es-
10
tuary watershed;
11
ββ(C) the San Francisco Bay Restoration
12
Authority; and
13
ββ(D) any other relevant stakeholder in-
14
volved with the protection and restoration of
15
the San Francisco Bay estuary that the Direc-
16
tor determines to be appropriate.

ββ(d) SAN FRANCISCO BAY PLAN.β
18
ββ(1) IN
GENERAL.βNot later than 5 years
19
after the date of enactment of this section, the Di-
20
rector, in conjunction with the Estuary Partnership,
21
shall review and revise the comprehensive conserva-
22
tion and management plan approved under section
23
320 for the San Francisco Bay estuary to develop
24
a plan to guide the projects, activities, and studies

of the Office to address the restoration and protec-

tion of the San Francisco Bay.

REVISION
OF
SAN
FRANCISCO
BAY

PLAN.βNot less often than once every 5 years after
4
the date of the completion of the plan described in
5
paragraph (1), the Director shall review, and revise
6
as appropriate, the San Francisco Bay Plan.

ββ(3) OUTREACH.βIn carrying out this sub-
8
section, the Director shall consult with the Estuary
9
Partnership and Indian tribes and solicit input from
10
other non-Federal stakeholders.
11
ββ(e) GRANT PROGRAM.β
12
ββ(1) IN GENERAL.βThe Director may provide
13
funding through cooperative agreements, grants, or
14
other means to State and local agencies, special dis-
15
tricts, and public or nonprofit agencies, institutions,
16
and organizations, including the Estuary Partner-
17
ship, for projects, activities, and studies identified on
18
the annual priority list compiled under subsection
19
(c).

ββ(2) MAXIMUM AMOUNT OF GRANTS; NON-FED-
21
ERAL SHARE.β

ββ(A) MAXIMUM

Amounts provided to any entity under this sec-
24
tion for a fiscal year shall not exceed an

amount equal to 75 percent of the total cost of
1
any projects, activities, and studies that are to
2
be carried out using those amounts.

ββ(B) NON-FEDERAL
SHARE.βNot less
4
than 25 percent of the cost of any project, ac-
5
tivity, or study carried out using amounts pro-
6
vided under this section shall be provided from
7
non-Federal sources.

ββ(f) FUNDING.β
9
ββ(1) AUTHORIZATION
OF
APPROPRIATIONS.β
10
There is authorized to be appropriated to carry out
11
this section $25,000,000 for each of fiscal years
12
2021 through 2025.

ββ(2)
ADMINISTRATIVE
EXPENSES.βOf
the
14
amount made available to carry out this section for
15
a fiscal year, the Director may not use more than
16
5 percent to pay administrative expenses incurred in
17
carrying out this section.
18
ββ(3) PROHIBITION.βNo amounts made avail-
19
able under this section may be used for the adminis-
20
tration of a management conference under section
21
320.

ββ(g) ANNUAL BUDGET PLAN.βIn each of fiscal
23
years 2021 through 2025, the President, as part of the
24
annual budget submission of the President to Congress

under section 1105(a) of title 31, United States Code,

shall submit information regarding each Federal depart-
2
ment and agency involved in San Francisco Bay protection
3
and restoration, includingβ
4
ββ(1) a report that displays for each Federal
5
agencyβ
6
ββ(A) the amounts obligated in the pre-
7
ceding fiscal year for protection and restoration
8
projects, activities, and studies relating to the
9
San Francisco Bay; and
10
ββ(B) the proposed budget for protection
11
and restoration projects, activities, and studies
12
relating to the San Francisco Bay; and
13
ββ(2) a description and assessment of the Fed-
14
eral role in the implementation of the San Francisco
15
Bay Plan and the specific role of each Federal de-
16
partment and agency involved in San Francisco Bay
17
protection
and
restoration,
including
specific
18
projects, activities, and studies conducted or planned
