Be it enacted by the Senate and House of Representa-
1
tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Restore Our Parks and
4
Public Lands Act’’.
5
SEC. 2. NATIONAL PARK SERVICE AND PUBLIC LANDS LEG-
6
ACY RESTORATION FUND.
7
(a) IN GENERAL.—There is established in the Treasury
8
of the United States a fund, to be known as the ‘‘National
9
Park Service and Public Lands Legacy Restoration Fund’’
10
(referred to in this section as the ‘‘Fund’’).
11
(b) DEPOSITS.—
12
(1) IN GENERAL.—Except as provided in para-
13
graph (2), for each of fiscal years 2020 through 2024,
14
there shall be deposited in the Fund an amount equal
15
to 50 percent of all energy development revenues due
16
and payable to the United States from oil, gas, coal,
17
or alternative or renewable energy development on
18
Federal land and water that would otherwise be cred-
19
ited, covered, or deposited as miscellaneous receipts
20
under Federal law.
21
(2) MAXIMUM AMOUNT.—The amount deposited
22
in the Fund under paragraph (1) shall not exceed
23
$1,300,000,000 for any fiscal year.

(3) EFFECT ON OTHER REVENUES.—Nothing in
1
this section affects the disposition under Federal law,
2
including the Gulf of Mexico Energy Security Act of
3
2006 (43 U.S.C. 1331 note; Public Law 109–432), the
4
Mineral Leasing Act (30 U.S.C. 181 et seq.), and
5
chapter 2003 of title 54, United States Code, of en-
6
ergy development revenues—
7
(A) to special funds, trust funds, or States;
8
or
9
(B) that have been otherwise appropriated
10
under Federal law.
11
(c) AVAILABILITY OF FUNDS.—Amounts deposited in
12
the Fund shall be available to the Secretary of the Interior
13
without further appropriation or fiscal year limitation.
14
(d) INVESTMENT OF AMOUNTS.—
15
(1) IN GENERAL.—The Secretary of the Interior
16
may request the Secretary of the Treasury to invest
17
any portion of the Fund that is not, as determined
18
by the Secretary of the Interior, required to meet the
19
current needs of the Fund.
20
(2) REQUIREMENT.—An investment requested
21
under paragraph (1) shall be made by the Secretary
22
of the Treasury in a public debt security—

(A) with a maturity suitable to the needs of
1
the Fund, as determined by the Secretary of the
2
Interior; and
3
(B) bearing interest at a rate determined by
4
the Secretary of the Treasury, taking into con-
5
sideration current market yields on outstanding
6
marketable obligations of the United States of
7
comparable maturity.
8
(3) CREDITS TO FUND.—The income on invest-
9
ments of the Fund under this subsection shall be cred-
10
ited to, and form a part of, the Fund.
11
(e) USE OF FUNDS.—
12
(1) IN GENERAL.—Amounts in the Fund shall be
13
used as follows:
14
(A) Eighty percent of amounts in the Fund
15
shall be allocated for priority deferred mainte-
16
nance projects, including other infrastructure de-
17
ficiencies directly related to such deferred main-
18
tenance projects, as determined by the Secretary
19
of the Interior and the Director of the National
20
Park Service, with the goal of ensuring overall
21
parity between amounts allocated to transpor-
22
tation and non-transportation projects.
23
(B) Ten percent of amounts in the Fund
24
shall be allocated for purposes of addressing the

national wildlife refuge system maintenance

backlog, as determined by the Secretary of the
2
Interior and the Director of the United States
3
Fish and Wildlife Service.
4
(C) Five percent of amounts in the Fund
5
shall be allocated for the purposes of addressing
6
the public access and recreation backlog on pub-
7
lic lands, as determined by the Secretary of the
8
Interior and the Director of the Bureau of Land
9
Management.
10
(D) Five percent of amounts in the Fund
11
shall be allocated for the purposes of addressing
12
the Bureau of Indian Education school construc-
13
tion and deferred maintenance backlogs, as deter-
14
mined by the Secretary of the Interior and the
15
Director of the Bureau of Indian Education.
16
(2) CONSIDERATION
OF
PROJECT
LIFESPAN.—
17
The Secretary of the Interior shall take into consider-
18
ation the projected lifespan of any project under this
19
Act when prioritizing which such projects to fund
20
under paragraph (1).
21
(f) LIMIT ON USE OF FUNDS.—No more than 10 per-
22
cent of the amounts in the Fund may be used for adminis-
23
trative costs incurred in implementing this Act.

(g) PROHIBITED USE OF FUNDS.—No amounts in the
1
Fund shall be used—
2
(1) for land acquisition;
3
(2) to supplant discretionary funding made
4
available for the annually recurring facility oper-
5
ations, maintenance, and construction needs of the
6
entities for which amounts from the Fund are allo-
7
cated under subsection (e); or
8
(3) for performance awards for Federal employ-
9
ees who are employed in implementing this Act.
10
(h) SUBMISSION TO CONGRESS.—The Secretary of the
11
Interior shall submit to the Committees on Appropriations
12
and Natural Resources of the House of Representatives and
13
to the Committees on Appropriations and Energy and Nat-
14
ural Resources of the Senate, with the annual budget sub-
15
mission of the President, a list of projects for which the
16
amounts in the Fund are allocated under this section, in-
17
cluding a description of each such project.
18
(i) PUBLIC DONATIONS.—
19
(1) IN GENERAL.—The Secretary of the Interior,
20
the Director of the National Park Service, the Direc-
21
tor of the United States Fish and Wildlife Service, the
22
Director of the Bureau of Land Management, and the
23
Assistant Secretary — Indian Affairs may accept

public cash or in-kind donations that advance ef-
1
forts—
2
(A) to reduce the deferred maintenance
3
backlog of the National Park Service, the na-
4
tional wildlife refuge system maintenance back-
5
log of the United States Fish and Wildlife Serv-
6
ice, the public access and recreation backlog of
7
the Bureau of Land Management, and the school
8
construction backlog of the Bureau of Indian
9
Education, respectively; and
10
(B) to encourage relevant public-private
11
partnerships.
12
(2) CREDITS TO FUND.—Any cash donations ac-
13
cepted under paragraph (1) shall be credited to, and
14
form a part of, the Fund.
15
(3) REPORTING.—Each donation received under
16
paragraph (1) that is used for, or directly related to,
17
the reduction of the deferred maintenance backlog of
18
