Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Student and Teacher 4 Safety Act of 2019’’. 5 SEC. 2. SUPPORTING SAFER SCHOOLS. 6 (a) STUDENT SUPPORT AND ACADEMIC ENRICH- 7 MENT GRANTS.—Subpart 1 of part A of title IV of the 8 Elementary and Secondary Education Act of 1965 (20 9 U.S.C. 7111 et seq.) is amended— 10 VerDate Sep 11 2014 02:26 Feb 26, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1192.IH H1192 pamtmann on DSKBFK8HB2PROD with BILLS 2 •HR 1192 IH (1) by redesignating sections 4109 through 1 4112 as sections 4110 through 4113, respectively; 2 and 3 (2) by inserting after section 4108 the fol- 4 lowing: 5 ‘‘SEC. 4109. ACTIVITIES TO SUPPORT SCHOOL SAFETY AND 6 PREVENT VIOLENCE AGAINST STUDENTS OR 7 SCHOOL PERSONNEL. 8 ‘‘Each local educational agency, or consortium of 9 such agencies, that receives an allocation under section 10 4105(a) may use such funds for school safety infrastruc- 11 ture improvements to prevent, mitigate, or respond to inci- 12 dents of violence.’’. 13 (b) DEFINITIONS.—Section 4102 of the Elementary 14 and Secondary Education Act of 1965 (20 U.S.C. 7112) 15 is amended— 16 (1) in paragraph (5)(B), by inserting ‘‘including 17 the prevention of gun violence,’’ after ‘‘school safe- 18 ty,’’; 19 (2) by redesignating paragraphs (7) and (8) as 20 paragraphs (8) and (9), respectively; and 21 (3) by inserting after paragraph (6) the fol- 22 lowing: 23 ‘‘(7) SCHOOL SAFETY INFRASTRUCTURE IM- 24 PROVEMENTS.—The term ‘school safety infrastruc- 25 VerDate Sep 11 2014 02:26 Feb 26, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1192.IH H1192 pamtmann on DSKBFK8HB2PROD with BILLS 3 •HR 1192 IH ture improvements’ means improvements to the 1 physical facility or technology of a school to prevent 2 intruders from entering a school, ensure students 3 and school personnel may safely enter the school 4 building and exit during an emergency, or protect 5 the life and well-being of students and school per- 6 sonnel, including— 7 ‘‘(A) physical improvements to the school 8 to prevent and deter unauthorized access to the 9 school, including locks, double entry systems, 10 hardened entrances, and interior and exterior 11 video surveillance systems; 12 ‘‘(B) security doors, automatic locks, secu- 13 rity glass, alarm systems, metal detectors, and 14 sensor systems; 15 ‘‘(C) emergency communications systems, 16 including wireless and geographically precise 17 mobile alert systems; 18 ‘‘(D) perimeter fencing; 19 ‘‘(E) emergency exit systems; 20 ‘‘(F) duress or panic systems; 21 ‘‘(G) emergency tip lines; and 22 ‘‘(H) any other physical improvements to 23 existing facilities where the primary purpose is 24 to improve or enhance school safety.’’. 25 VerDate Sep 11 2014 02:26 Feb 26, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1192.IH H1192 pamtmann on DSKBFK8HB2PROD with BILLS 4 •HR 1192 IH (c) FORMULA GRANTS TO STATES.—Section 4103(a) 1 of the Elementary and Secondary Education Act of 1965 2 (20 U.S.C. 7113(a)) is amended, in the matter preceding 3 paragraph (1), by striking ‘‘section 4112’’ and inserting 4 ‘‘section 4113’’. 5 (d) STATE USE OF FUNDS.—Section 4104(b)(3)(B) 6 of the Elementary and Secondary Education Act of 1965 7 (20 U.S.C. 7114(b)(3)(B)) is amended— 8 (1) in clause (iii), by striking ‘‘and’’ at the end; 9 and 10 (2) by adding at the end the following: 11 ‘‘(v) improving the safety and security 12 of schools, which may include— 13 ‘‘(I) identifying and dissemi- 14 nating best practices for school safety; and 3 ‘‘(IV) school safety infrastructure 4 improvements; and’’. 5 (e) LOCAL EDUCATIONAL AGENCY APPLICATIONS.— 6 Section 4106(e) of the Elementary and Secondary Edu- 7 cation Act of 1965 (20 U.S.C. 7116(e)) is amended— 8 (1) in paragraph (1)— 9 (A) in subparagraph (D)— 10 (i) by striking ‘‘4109’’ and inserting 11 ‘‘4110’’; and 12 (ii) by striking ‘‘and’’ at the end; 13 (B) by redesignating subparagraph (E) as 14 subparagraph (F); and 15 (C) by inserting after subparagraph (D), 16 the following: 17 ‘‘(E) if applicable, how funds will be used 18 for activities related to supporting school safety 19 infrastructure improvements under section 20 4109; 3 (C) by inserting after subparagraph (D) 4 the following: 5 ‘‘(E) use a portion of funds received under 6 this subpart to support one or more of the ac- 7 tivities authorized under section 4109;’’; and 8 (D) in subparagraph (F), as so redesig- 9 nated— 10 (i) by striking ‘‘section 4109(a)’’ and 11 inserting ‘‘section 4110(a)’’; and 12 (ii) by striking ‘‘section 4109(b)’’ and 13 inserting ‘‘section 4110(b)’’. 14 (f) ACTIVITIES TO SUPPORT SAFE AND HEALTHY 15 STUDENTS.—Section 4108(a)(5) of the Elementary and 16 Secondary Education Act of 1965 (20 U.S.C. 7118(a)(5)) 17 is amended— 18 (1) in subparagraph (B), in the matter pre- 19 ceding clause (i), by striking ‘‘4111’’ and inserting 20 ‘‘4112’’; 5 (B) in paragraph (6), by striking the pe- 6 riod at the end and inserting ‘‘; and’’; and 7 (C) by adding at the end the following: 8 ‘‘(7) providing technology to improve school 9 safety.’’; and 10 (2) in subsection (b)— 11 (A) by striking ‘‘A local’’ and inserting the 12 following: 13 ‘‘(1) IN GENERAL.—A local’’; and 14 (B) by adding at the end the following: 15 ‘‘(2) EXCEPTION.—The limitation described in 16 paragraph (1) shall not apply to technology infra- 17 structure that is also a school safety infrastructure 18 improvement.’’. 19 (h) TECHNICAL AMENDMENT.—The table of contents 20 in section 2 of the Elementary and Secondary Education 21 Act is amended by striking the items relating to sections 22 4109, 4110, 4111, and 4112 and inserting the following: 23 ‘‘Sec. 4109. Activities to support school safety and prevent violence against stu- dents or school personnel. ‘‘Sec. 4110. Activities to support the effective use of technology. ‘‘Sec. 4111. Supplement, not supplant.
