To amend title 31, United States Code, to provide for automatic continuing
appropriations, to withhold the pay of the President and Members of
Congress during any period in which such automatic continuing appro-
priations are in effect, and for other purposes.

which was referred to the Committee on Appropriations, and in addition
to the Committees on Oversight and Reform, House Administration, and
the Budget, for a period to be subsequently determined by the Speaker,
in each case for consideration of such provisions as fall within the juris-
diction of the committee concerned
A BILL
To amend title 31, United States Code, to provide for auto-
matic continuing appropriations, to withhold the pay of
the President and Members of Congress during any pe-
riod in which such automatic continuing appropriations
are in effect, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Ensure Washington
4
Funds Government Responsibly Act’’.

SEC. 2. AUTOMATIC CONTINUING APPROPRIATIONS.

(a) IN GENERAL.—Chapter 13 of title 31, United
2
States Code, is amended by inserting after section 1310
3
the following new section:
4
‘‘SEC. 1311. CONTINUING APPROPRIATIONS.
5
‘‘(a)(1) If any appropriation measure for a fiscal year
6
is not enacted before the beginning of such fiscal year or
7
a joint resolution making continuing appropriations is not
8
in effect, there are appropriated such sums as may be nec-
9
essary to continue any program, project, or activity for
10
which funds were provided in the preceding fiscal year—
11
‘‘(A) in the corresponding appropriation Act for
12
such preceding fiscal year; or
13
‘‘(B) if the corresponding appropriation bill for
14
such preceding fiscal year did not become law, then
15
in a joint resolution making continuing appropria-
16
tions for such preceding fiscal year.
17
‘‘(2)(A) Appropriations and funds made available,
18
and authority granted, for a program, project, or activity
19
for any fiscal year pursuant to this section shall be at a
20
rate of operations not in excess of the lower of—
21
‘‘(i) 100 percent of the rate of operations pro-
22
vided for in the regular appropriation Act providing
23
for such program, project, or activity for the pre-
24
ceding fiscal year, increased by the percent increase
25
(if any) in the Consumer Price Index for Urban

Consumers (CPI–U, published by the Bureau of

Labor Statistics of the Department of Labor) be-
2
tween the 2 months immediately preceding the date
3
this section begins to be in effect;
4
‘‘(ii) in the absence of such an Act, 100 percent
5
of the rate of operations provided for such program,
6
project, or activity pursuant to a joint resolution
7
making continuing appropriations for such preceding
8
fiscal year, increased by the percent increase (if any)
9
in the CPI–U between the 2 months immediately
10
preceding the date this section begins to be in effect;
11
or
12
‘‘(iii) 100 percent of the annualized rate of op-
13
erations provided for in the most recently enacted
14
joint resolution making continuing appropriations
15
for part of that fiscal year or any funding levels es-
16
tablished under the provisions of this Act, increased
17
by the percent increase (if any) in the CPI–U be-
18
tween the 2 months immediately preceding the date
19
this section begins to be in effect.
20
‘‘(B) During the period in which this section is in
21
effect in a fiscal year, the applicable rate of operations
22
under subparagraph (A) shall be increased by the percent
23
increase (if any) in the CPI–U. The increase provided
24
under this subparagraph shall—

‘‘(i) occur on any date during such period that
1
the Bureau publishes the CPI–U; and
2
‘‘(ii) extend beyond the last day of that fiscal
3
year in the same manner.

‘‘(C) If this section is in effect at the end of a fiscal
5
year, funding levels shall continue as provided in this sec-
6
tion for the next fiscal year.
7
‘‘(D) During any period in which this section is in
8
effect, any sequestration order with respect to discre-
9
tionary spending under section 254 of the Balanced Budg-
10
et and Emergency Deficit Control Act of 1985 (2 U.S.C.
11
904) shall have no force or effect.
12
‘‘(3) Appropriations and funds made available, and
13
authority granted, for any fiscal year pursuant to this sec-
14
tion for a program, project, or activity shall be available
15
for the period beginning with the first day of a lapse in
16
appropriations and ending with the date on which the ap-
17
plicable regular appropriation bill for such fiscal year be-
18
comes law (whether or not such law provides for such pro-
19
gram, project, or activity) or a continuing resolution mak-
20
ing appropriations becomes law, as the case may be.
21
‘‘(b) An appropriation or funds made available, or au-
22
thority granted, for a program, project, or activity for any
23
fiscal year pursuant to this section shall be subject to the
24
terms and conditions imposed with respect to the appro-

priation made or funds made available for the preceding
1
fiscal year, or authority granted for such program, project,
2
or activity under current law.

‘‘(c) Expenditures made for a program, project, or
4
activity for any fiscal year pursuant to this section shall
5
be charged to the applicable appropriation, fund, or au-
6
thorization whenever a regular appropriation bill or a joint
7
resolution making continuing appropriations until the end
8
of a fiscal year providing for such program, project, or
9
activity for such period becomes law.

‘‘(d) This section shall not apply to a program,
11
project, or activity during a fiscal year if any other provi-
12
sion of law (other than an authorization of appropria-
13
tions)—
14
‘‘(1) makes an appropriation, makes funds
15
available, or grants authority for such program,
16
project, or activity to continue for such period; or
17
‘‘(2) specifically provides that no appropriation
18
shall be made, no funds shall be made available, or
19
no authority shall be granted for such program,
20
project, or activity to continue for such period.’’.

(b) CLERICAL AMENDMENT.—The table of sections
22
of chapter 13 of title 31, United States Code, is amended
23
by inserting after the item relating to section 1310 the
24
following new item:

‘‘1311. Continuing appropriations.’’.

SEC. 3. PROHIBITING PAYING THE PRESIDENT OR MEM-
1
BERS OF CONGRESS WHILE AUTOMATIC CON-
2
TINUING APPROPRIATIONS ARE IN EFFECT.
3
(a) RULE FOR ONE HUNDRED SIXTEENTH CON-
4
GRESS.—
5
(1) HOLDING SALARIES IN ESCROW.—If a pay
6
period occurs during the One Hundred Sixteenth
7
Congress during the period described in paragraph
8
(2), the payroll administrator of each House of Con-
9
gress shall—
10
(A) deposit in an escrow account and ex-
11
clude from the payments otherwise required to
12
be made with respect to that pay period for the
13
compensation of each Member of Congress who
14
serves in that House of Congress an amount
15
equal to the product of—
16
(i) the daily rate of pay of the Mem-
17
ber under section 601(a) of the Legislative
18
Reorganization Act of 1946 (2 U.S.C.
19
4501); and
20
(ii) the number of 24-hour periods
21
during the pay period; and
22
(B) release amounts deposited in an es-
23
crow account under subparagraph (A) to such
24
Member of Congress only upon the expiration of
25
the period described in paragraph (2).

(2) PERIOD DESCRIBED.—The period described
1
in this paragraph is the period that—
2
(A) begins on the day on which appropria-
3
tions and funds are made available pursuant to
4
section 1311 of title 31, United States Code (as
5
added by section 3(a)); and
6
(B) ends on the earlier of—
7
(i) the date on which appropriations
8
and funds are no longer made available
9
pursuant to section 1311 of such title; or
10
(ii) the last day of the One Hundred
11
Sixteenth Congress.

(3)
WITHHOLDING
AND
REMITTANCE
OF
13
AMOUNTS FROM PAYMENTS HELD IN ESCROW.—The
14
payroll administrator of each House of Congress
15
shall provide for the same withholding and remit-
16
tance with respect to a payment deposited in an es-
17
crow account under paragraph (1) that would apply
18
to the payment if the payment were not subject to
19
paragraph (1).

(4) RELEASE OF AMOUNTS AT END OF THE
21
CONGRESS.—In order to ensure that this subsection
22
is carried out in a manner that shall not vary the
23
compensation of Senators or Representatives in vio-
24
lation of the twenty-seventh amendment to the Con-

stitution of the United States, the payroll adminis-
1
trator of a House of Congress shall release for pay-
2
ment to Members of that House of Congress any
3
amounts remaining in any escrow account under this
4
section on the last day of the One Hundred Six-
5
teenth Congress.

(b) SUBSEQUENT CONGRESSES.—
7
(1) REDUCTION IN SALARIES.—If a pay period
8
occurs during the One Hundred Seventeenth Con-
9
gress or any succeeding Congress during the period
10
described in paragraph (2), the payroll administrator
11
of each House of Congress shall exclude from the
12
payments otherwise required to be made with re-
13
spect to that pay period for the compensation of
14
each Member of Congress who serves in that House
15
of Congress an amount equal to the product of—
16
(A) the daily rate of pay of the Member
17
under section 601(a) of the Legislative Reorga-
18
nization Act of 1946 (2 U.S.C. 4501); and
19
(B) the number of 24-hour periods during
20
the pay period.
21
(2) PERIOD DESCRIBED.—The period described
22
in this paragraph is the period that—
23
(A) begins on the day on which appropria-
24
tions and funds are made available pursuant to

section 1311 of title 31, United States Code (as
1
added by section 3(a)); and
2
(B) ends on the date on which appropria-
3
tions and funds are no longer made available
4
pursuant to section 1311 of such title.

(c) PRESIDENT’S SALARY.—The salary of the Presi-
6
dent shall be withheld, deposited in escrow, and released
7
in the same manner as prescribed under subsections (a)
8
and (b) for a Member of Congress.
9
(d) ROLE OF SECRETARY OF THE TREASURY.—The
10
Secretary of the Treasury shall provide the payroll admin-
11
istrator of each House of Congress with such assistance
12
as may be necessary to enable the payroll administrator
13
to carry out this section.
14
(e) DEFINITION.—In this section, the following defi-
15
nitions apply:
16
(1) The term ‘‘Member of Congress’’ means a
17
Senator or a Representative in, or Delegate or Resi-
18
dent Commissioner to, the Congress.
19
(2) The term ‘‘payroll administrator’’, with re-
20
spect to a House of Congress, means—
21
(A) in the case of the House of Represent-
22
atives, the Chief Administrative Officer of the
23
House of Representatives, or an employee of
24
the Office of the Chief Administrative Officer

who is designated by the Chief Administrative

Officer to carry out this section; and
2
(B) in the case of the Senate, the Sec-
3
retary of the Senate, or an employee of the Of-
4
fice of the Secretary of the Senate who is des-
5
ignated by the Secretary to carry out this sec-
6
tion.
