Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. DISCLOSURE OF CERTAIN DONATIONS TO AND 1 SPENDING BY THE PRESIDENTIAL INAU- 2 GURAL COMMITTEE. 3 Section 510 of title 36, United States Code, is 4 amended— 5 (1) in subsection (b)— 6 (A) in paragraph (1), by inserting ‘‘, and 7 disclosing any disbursement made in an amount 8 equal to or greater than $200 and the purpose 9 of each disbursement’’ before the period at the 10 end; and 11 (B) in paragraph (2)— 12 (i) in subparagraph (B), by striking 13 ‘‘and’’ at the end; 14 (ii) in subparagraph (C), by striking 15 the period at the end and inserting ‘‘; 16 and’’; and 17 (iii) by adding at the end the fol- 18 lowing: 19 ‘‘(D) for any disbursement in an amount 20 equal to or greater than $200 that is made, in- 21 cluding any such disbursement made after the 22 end of the inaugural period— 23 ‘‘(i) the name and address of the per- 24 son to whom the disbursement was made; 25 VerDate Sep 11 2014 20:53 Feb 21, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S484.IS S484 pamtmann on DSKBFK8HB2PROD with BILLS 3 •S 484 IS ‘‘(ii) the date on which the disburse- 1 ment was made; and 2 ‘‘(iii) the total amount and purpose of 3 the disbursement.’’; 4 (2) by amending subsection (c) to read as fol- 5 lows: 6 ‘‘(c) PROHIBITION.— 7 ‘‘(1) IN GENERAL.—It shall be unlawful— 8 ‘‘(A) for an Inaugural Committee to solicit, 9 accept, or receive a donation from a foreign na- 10 tional; 11 ‘‘(B) for a person— 12 ‘‘(i) to make a donation to an Inau- 13 gural Committee in the name of another 14 person, or to knowingly authorize his or 15 her name to be used to effect such a dona- 16 tion; or 17 ‘‘(ii) to knowingly accept a donation 18 to an Inaugural Committee made by a per- 19 son in the name of another person; 20 ‘‘(C) for a foreign national to, directly or 21 indirectly, make a donation, or make an express 22 or implied promise to make a donation, to an 23 Inaugural Committee; or 24 VerDate Sep 11 2014 20:53 Feb 21, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S484.IS S484 pamtmann on DSKBFK8HB2PROD with BILLS 4 •S 484 IS ‘‘(D) to convert a donation to an Inaugural 1 Committee to personal use as described in para- 2 graph (3). 3 ‘‘(2) DEFINITION OF FOREIGN NATIONAL.—In 4 this subsection, the term ‘foreign national’ has the 5 meaning given the term in section 319(b) of the 6 Federal Election Campaign Act of 1971 (2 U.S.C. 7 441e(b)). 8 ‘‘(3) CONVERSION OF DONATION TO PERSONAL 9 USE.—For purposes of paragraph (1)(D), a donation 10 shall be considered to be converted to personal use 11 if any part of the donated amount is used to fulfill 12 a commitment, obligation, or expense of a person 13 that would exist irrespective of the responsibilities of 14 the Inaugural Committee.’’; and 15 (3) by adding at the end the following: 16 ‘‘(d) REQUIREMENT.— 17 ‘‘(1) IN GENERAL.—Not later than the date 18 that is 90 days after the date of the Presidential in- 19 augural ceremony, the committee shall disburse any 20 remaining donated funds to an organization de- 21 scribed in section 501(c)(3) of the Internal Revenue 22 Code of 1986 and exempt from taxation under sec- 23 tion 501(a) of such Code. 24 ‘‘(2) EXTENSION.— 25 VerDate Sep 11 2014 20:53 Feb 21, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S484.IS S484 pamtmann on DSKBFK8HB2PROD with BILLS 5 •S 484 IS ‘‘(A) REQUEST.—Upon request from the 1 Inaugural Committee, the Federal Election 2 Commission may extend the 90-day period de- 3 scribed in paragraph (1). 4 ‘‘(B) SUPPLEMENTAL REPORT.—In the 5 case of an extension under subparagraph (A), 6 the Inaugural Committee shall, not later than 7 the last day of the extension period, file a sup- 8 plement to the report required under subsection 9 (b)(1).’’. 10 Æ VerDate Sep 11 2014 20:53 Feb 21, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S484.IS S484 pamtmann on DSKBFK8HB2PROD with BILLS
