Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Toxic Health Threat
4
Warning Act of 2019’’.

SEC. 2. RELEASES OF WATER CONTAMINATED WITH CY-

ANOBACTERIA.

(a) DETERMINATION.—Before releasing water from
3
a flood risk management project, the Secretary shall deter-
4
mine whether the water is contaminated with cyanobacte-
5
ria, based on tests conducted by the Secretary, another
6
Federal agency, or the State in which the flood risk man-
7
agement project is located.

(b) NOTIFICATION.—If the Secretary determines
9
under subsection (a) that water to be released from a flood
10
risk management project is contaminated with cyanobacte-
11
ria, the Secretary shall notify the public and affected gov-
12
ernments of the contamination and planned release, and
13
any potential effects on human health, before releasing the
14
water.

(c) DEFINITIONS.—In this section:
16
(1) AFFECTED GOVERNMENT.—The term ‘‘af-
17
fected government’’ means a State, local, or Tribal
18
government with jurisdiction over an area that will
19
be affected by a release of water from a flood risk
20
management project.
21
(2) SECRETARY.—The term ‘‘Secretary’’ means
22
the Secretary of the Army, acting through the Chief
23
of Engineers.
