Mr. BISHOP of Utah submitted the following joint resolution; which was
referred to the Committee on the Judiciary
JOINT RESOLUTION
Proposing an amendment to the Constitution of the United
States to give States the authority to repeal Federal
rules and regulations when the repeal is agreed to by
the legislatures of two-thirds of the several States.
Resolved by the Senate and House of Representatives

of the United States of America in Congress assembled

(two-thirds of each House concurring therein), That the fol-
3
lowing article is proposed as an amendment to the Con-
4
stitution of the United States, which shall be valid to all
5
intents and purposes as part of the Constitution when
6
ratified by the legislatures of three-fourths of the several

States within seven years after the date of its submission

for ratification:

‘‘ARTICLE —
3
‘‘SECTION 1. The several States may repeal, in whole
4
or in part, any Presidential Executive order, rule, regula-
5
tion, other regulatory action, or administrative ruling
6
issued by a department, agency, or instrumentality of the
7
United States. Such repeal shall take effect upon approval
8
by the legislatures of two-thirds of the several States of
9
resolutions for this purpose that particularly describe the
10
same whole or part of the Executive order, rule, regula-
11
tion, other regulatory action, or administrative ruling to
12
be repealed.

‘‘SECTION 2. Congress shall have power to enforce
14
this article by appropriate legislation.’’.
