SHORT TITLE. 1 This Act may be cited as the ‘‘Venezuela TPS Act 2 of 2019’’. 3 SEC. 2. DESIGNATION FOR PURPOSES OF GRANTING TEM- 4 PORARY PROTECTED STATUS. 5 (a) DESIGNATION.— 6 (1) IN GENERAL.—For purposes of section 244 7 of the Immigration and Nationality Act (8 U.S.C. 8 1254a), Venezuela shall be treated as if it had been 9 designated under subsection (b)(1)(C) of that sec- 10 tion, subject to the provisions of this section. 11 (2) PERIOD OF DESIGNATION.—The initial pe- 12 riod of the designation referred to in paragraph (1) 13 shall be for the 18-month period beginning on the 14 date of the enactment of this Act. 15 (b) ALIENS ELIGIBLE.—As a result of the designa- 16 tion made under subsection (a), an alien who is a national 17 of Venezuela is deemed to satisfy the requirements under 18 paragraph (1) of section 244(c) of the Immigration and 19 Nationality Act (8 U.S.C. 1254a(c)), subject to paragraph 20 (3) of such section, if the alien— 21 (1) has been continuously physically present in 22 the United States since the date of the enactment of 23 this Act; 24 (2) is admissible as an immigrant, except as 25 otherwise provided in paragraph (2)(A) of such sec- 26 VerDate Sep 11 2014 22:56 Jul 29, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H549.RFS H549 kjohnson on DSK79L0C42 with BILLS 3 HR 549 RFS tion, and is not ineligible for temporary protected 1 status under paragraph (2)(B) of such section; and 2 (3) registers for temporary protected status in 3 a manner established by the Secretary of Homeland 4 Security. 5 (c) CONSENT TO TRAVEL ABROAD.— 6 (1) IN GENERAL.—The Secretary of Homeland 7 Security shall give prior consent to travel abroad, in 8 accordance with section 244(f)(3) of the Immigra- 9 tion and Nationality Act (8 U.S.C. 1254a(f)(3)), to 10 an alien who is granted temporary protected status 11 pursuant to the designation made under subsection 12 (a) if the alien establishes to the satisfaction of the 13 Secretary of Homeland Security that emergency and 14 extenuating circumstances beyond the control of the 15 alien require the alien to depart for a brief, tem- 16 porary trip abroad. 17 (2) TREATMENT UPON RETURN.—An alien re- 18 turning to the United States in accordance with an 19 authorization described in paragraph (1) shall be 20 treated as any other returning alien provided tem- 21 porary protected status under section 244 of the Im- 22 migration and Nationality Act (8 U.S.C. 1254a). 23 (d) FEE.— 24 VerDate Sep 11 2014 22:56 Jul 29, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H549.RFS H549 kjohnson on DSK79L0C42 with BILLS 4 HR 549 RFS (1) IN GENERAL.—In addition to any other fee 1 authorized by law, the Secretary of Homeland Secu- 2 rity is authorized to charge and collect a fee of $360 3 for each application for temporary protected status 4 under section 244 of the Immigration and Nation- 5 ality Act by a person who is only eligible for such 6 status by reason of subsection (a). 7 (2) WAIVER.—The Secretary of Homeland Se- 8 curity shall permit aliens to apply for a waiver of 9 any fees associated with filing an application re- 10 ferred to in paragraph (1). 11 SEC. 3. DETERMINATION OF BUDGETARY EFFECTS. 12 The budgetary effects of this Act, for the purpose of 13 complying with the Statutory Pay-As-You-Go Act of 2010, 14 shall be determined by reference to the latest statement 15 titled ‘‘Budgetary Effects of PAYGO Legislation’’ for this 16 Act, submitted for printing in the Congressional Record 17 by the Chairman of the House Budget Committee, pro- 18 vided that such statement has been submitted prior to the 19 vote on passage. 20 Passed the House of Representatives July 25, 2019.
