Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. STUDY OF WELL-BEING OF UNITED STATES AUTO- 1 MOTIVE INDUSTRY; STAY OF CERTAIN INVES- 2 TIGATION. 3 (a) STUDY REQUIRED.—The United States Inter- 4 national Trade Commission (in this section referred to as 5 the ‘‘Commission’’) shall conduct a study of the economic 6 well-being, health, and vitality of the United States auto- 7 motive industry, which shall include an assessment of the 8 following: 9 (1) The number of automotive jobs in the 10 United States, regardless of whether the parent enti- 11 ty of the United States automotive producer is 12 headquartered in the United States or another coun- 13 try. 14 (2) Any growth or decline in number of auto- 15 mobile manufacturing facilities and automotive parts 16 suppliers in the United States since 1980. 17 (3) The effect an automotive plant has on the 18 unemployment rate, per capita income, and edu- 19 cation level in the community in which the plant is 20 located. 21 (4) The effect an automotive plant has on the 22 region in which the plant is located in helping the 23 region attract and expand nonautomotive jobs and 24 the effect on that region of the wages from those 25 jobs. 26 VerDate Sep 11 2014 04:18 Jan 23, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S121.IS S121 kjohnson on DSK79L0C42 with BILLS 3 •S 121 IS (5) The number of automobiles assembled in 1 the United States that are exported each year and 2 to which countries. 3 (6) The percentage of component parts of auto- 4 mobiles assembled in the United States that are im- 5 ported. 6 (7) The number of component parts for auto- 7 mobiles that are not produced in the United States 8 and would thus not be available to United States 9 automotive producers if prohibitively high duties 10 were imposed on imports of those parts. 11 (8) The effect an increase in automotive manu- 12 facturing costs would have on jobs in the United 13 States. 14 (b) REPORT.—Not earlier than 180 days after the 15 date of the enactment of this Act, and not later than one 16 year after such date of enactment, the Commission shall 17 submit to the President and Congress a report on— 18 (1) the findings of the study required by sub- 19 section (a); and 20 (2) any recommendations relating to the auto- 21 motive industry that the Commission considers ap- 22 propriate based on the study. 23 (c) STAY OF INVESTIGATION INTO NATIONAL SECU- 24 RITY EFFECTS OF AUTOMOTIVE IMPORTS.— 25 VerDate Sep 11 2014 04:18 Jan 23, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S121.IS S121 kjohnson on DSK79L0C42 with BILLS 4 •S 121 IS (1) IN GENERAL.—The Secretary of Commerce 1 shall stay the investigation of the Department of 2 Commerce under section 232 of the Trade Expan- 3 sion Act of 1962 (19 U.S.C. 1862) into the effects 4 on national security of imports of automobiles and 5 automotive parts initiated on May 23, 2018, until— 6 (A) the Commission submits to the Presi- 7 dent and Congress the report required by sub- 8 section (b); and 9 (B) the President, after reviewing the re- 10 port and considering the findings and rec- 11 ommendations of the Commission included in 12 the report, determines to reopen or terminate 13 the investigation. 14 (2) TOLLING OF CERTAIN DEADLINE.—The 15 deadline for completion of investigations under sec- 16 tion 232(b)(3)(A) of the Trade Expansion Act of 17 1962 (19 U.S.C. 1862(b)(3)(A)) shall be tolled for 18 the investigation described in paragraph (1) during 19 the period during which the investigation is stayed 20 under this subsection. 21 (d) UNITED STATES AUTOMOTIVE PRODUCER DE- 22 FINED.—In this section, the term ‘‘United States auto- 23 motive producer’’ means an entity that manufactures or 24 VerDate Sep 11 2014 04:18 Jan 23, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S121.IS S121 kjohnson on DSK79L0C42 with BILLS 5 •S 121 IS assembles automobiles or component parts for automobiles 1 in the United States. 2 Æ VerDate Sep 11 2014 04:18 Jan 23, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S121.IS S121 kjohnson on DSK79L0C42 with BILLS
