was read twice and referred to the Committee on Small Business and En-
trepreneurship
A BILL
To amend section 203 of Public Law 94–305 to ensure
proper authority for the Office of Advocacy of the Small
Business Administration, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Advocacy Empower-
4
ment Act of 2019’’.
5
SEC. 2. ADDITIONAL POWERS OF THE CHIEF COUNSEL FOR
6
ADVOCACY.
7
(a) CHIEF COUNSEL AUTHORITY.—Section 203(a) of
8
Public Law 94–305 (15 U.S.C. 634c(a)) is amended—

(1) in paragraph (5), by striking ‘‘and’’ at the

end;
2
(2) in paragraph (6), by striking the period at
3
the end and inserting a semicolon; and
4
(3) by adding at the end the following:

‘‘(7) issue, modify, or amend rules governing
6
compliance by agencies with chapter 6 of title 5,
7
United States Code, after opportunity for notice and
8
comment under section 553 of title 5, United States
9
Code; and
10
‘‘(8) authorize an agency to issue such supple-
11
mental rules governing compliance with chapter 6 of
12
title 5, United States Code, as the Chief Counsel
13
may approve, and ensure that the supplemental
14
rules comply with such chapter 6 and with the notice
15
and comment process under section 553 of title 5,
16
United States Code.’’.

(b) IMPLEMENTATION.—On and after the date that
18
is 270 days after the date of enactment of this Act, the
19
Chief Counsel for Advocacy of the Small Business Admin-
20
istration may exercise the authority under paragraphs (7)
21
and (8) of section 203(a) of Public Law 94–305 (15
22
U.S.C. 634c(a)), as added by subsection (a).
