to resolve an unauthorized use and an occupancy encroachment dating

A BILL
To authorize the Secretary of the Interior to convey certain
public land within the Henry’s Lake Wilderness Study
Area in the State of Idaho to resolve an unauthorized
use and an occupancy encroachment dating back to
1983.
Be it enacted by the Senate and House of Representa-

(a) CONVEYANCE
AND

Land Policy and Management Act of 1976 (43 U.S.C.
1
1782(c)), the Secretary of the Interior may—
2
(1) convey to the owner of a private residence
3
located at 3787 Valhalla Road in Island Park, Idaho
4
(in this section referred to as the ‘‘owner’’), all
5
right, title, and interest of the United States in and
6
to the approximately 0.5 acres of Federal land in the
7
Henry’s Lake Wilderness Study Area described as
8
lot 14, section 33, Township 16 North, Range 43
9
East, Boise Meridian, Fremont County, Idaho; and
10
(2) grant Fall River Electric in Ashton, Idaho,
11
the right to operate, maintain, and rehabilitate a
12
right-of-way encumbering approximately 0.4 acres of
13
Federal land in the Henry’s Lake Wilderness Study
14
Area described as lot 15, section 33, Township 16
15
North, Range 43 East, Boise Meridian, Fremont
16
County, Idaho, which includes an electric distribu-
17
tion line and access road, 850′ in length, 20′ in
18
width.

(b) CONSIDERATION; CONDITIONS.—
20
(1) LAND DISPOSAL.—The Secretary shall con-
21
vey the land under subsection (a)(1) in accordance
22
with section 203 of the Federal Land Policy and
23
Management Act of 1976 (43 U.S.C. 1713) and part
24
2711.3–3 of title 43, Code of Federal Regulations.

As consideration for the conveyance the owner shall

pay to the Secretary an amount equal to the fair
2
market value as valued by a qualified land appraisal
3
and approved by the Appraisal and Valuation Serv-
4
ices Office.

(2) RIGHT-OF-WAY.—The Secretary shall grant
6
the right-of-way granted under subsection (a)(2) in
7
accordance with section 205 of the Federal Land
8
Policy and Management Act of 1976 and part 2800
9
of title 43, Code of Federal Regulations.
10
(c) EXEMPTIONS.—Land conveyed under subsection
11
(a)(1) shall be exempt from all requirements of—
12
(1) the Bureau of Land Management Manual
13
6330—‘‘Management of BLM Wilderness Study
14
Areas’’; and
15
(2) the National Environmental Policy Act of
16
1969.
17
(d) ADDITIONAL TERMS
AND CONDITIONS.—The
18
Secretary may require such additional terms and condi-
19
tions in connection with the conveyance of the land and
20
the grant of the right-of-way under this section as the Sec-
21
retary considers appropriate to protect the interests of the
22
United States.
