To provide for the conveyance of the Custer County Airport,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. CUSTER COUNTY AIRPORT CONVEYANCE.
3
(a) DEFINITIONS.—In this section:
4
(1) COUNTY.—The term ‘‘County’’ means Cus-
5
ter County, South Dakota.
6
(2) FEDERAL LAND.—The term ‘‘Federal land’’
7
means all right, title, and interest of the United
8
States in and to approximately 65.7 acres of Na-

tional Forest System land, as generally depicted on

the map.

(3) MAP.—The term ‘‘map’’ means the map en-
3
titled ‘‘Custer County Airport Conveyance’’ and
4
dated October 19, 2017.
5
(4) SECRETARY.—The term ‘‘Secretary’’ means
6
the Secretary of Agriculture, acting through the
7
Chief of the Forest Service.
8
(b) LAND CONVEYANCE.—
9
(1) IN GENERAL.—Subject to the terms and
10
conditions described in paragraph (2), if the County
11
submits to the Secretary an offer to acquire the
12
Federal land for the market value, as determined by
13
the appraisal under paragraph (3), the Secretary
14
shall convey the Federal land to the County.
15
(2) TERMS AND CONDITIONS.—The conveyance
16
under paragraph (1) shall be—
17
(A) subject to valid existing rights;
18
(B) made by quitclaim deed; and
19
(C) subject to any other terms and condi-
20
tions as the Secretary considers appropriate to
21
protect the interests of the United States.

(3) APPRAISAL.—
23
(A) IN GENERAL.—Not later than 60 days
24
after the date of enactment of this Act, the Sec-

retary shall complete an appraisal to determine
1
the market value of the Federal land.
2
(B) STANDARDS.—The appraisal under
3
subparagraph (A) shall be conducted in accord-
4
ance with—
5
(i) the Uniform Appraisal Standards
6
for Federal Land Acquisitions; and
7
(ii) the Uniform Standards of Profes-
8
sional Appraisal Practice.

(4) MAP.—

(A) AVAILABILITY
OF
MAP.—The map
11
shall be kept on file and available for public in-
12
spection in the appropriate office of the Forest
13
Service.
14
(B) CORRECTION OF ERRORS.—The Sec-
15
retary may correct any errors in the map.
16
(5) CONSIDERATION.—As consideration for the
17
conveyance under paragraph (1), the County shall
18
pay to the Secretary an amount equal to the market
19
value of the Federal land, as determined by the ap-
20
praisal under paragraph (3).
21
(6) SURVEY.—The exact acreage and legal de-
22
scription of the Federal land to be conveyed under
23
paragraph (1) shall be determined by a survey satis-
24
factory to the Secretary.

(7) COSTS OF CONVEYANCE.—As a condition on
1
the conveyance under paragraph (1), the County
2
shall pay to the Secretary all costs associated with
3
the conveyance, including the cost of—
4
(A) the appraisal under paragraph (3); and
5
(B) the survey under paragraph (6).

(8) PROCEEDS FROM THE SALE OF LAND.—
7
Any proceeds received by the Secretary from the
8
conveyance under paragraph (1) shall be—
9
(A) deposited in the fund established under
10
Public Law 90–171 (commonly known as the
11
‘‘Sisk Act’’) (16 U.S.C. 484a); and
12
(B) available to the Secretary until ex-
13
pended, without further appropriation, for the
14
acquisition of inholdings in units of the Na-
15
tional Forest System in the State of South Da-
16
kota.
