To amend title 5, United States Code, to extend the basis for the denial
of retirement credit, for service as a Member of Congress, to include
conviction of any felony under Federal or State law, and for other
purposes.

Mr. YOHO introduced the following bill; which was referred to the Committee
on House Administration, and in addition to the Committee on Oversight
and Reform, for a period to be subsequently determined by the Speaker,
in each case for consideration of such provisions as fall within the juris-
diction of the committee concerned
A BILL
To amend title 5, United States Code, to extend the basis
for the denial of retirement credit, for service as a Mem-
ber of Congress, to include conviction of any felony under
Federal or State law, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Trust Returned to the
4
United States Taxpayer Act’’ or the ‘‘TRUST Act’’.

SEC. 2. AMENDMENTS.
1
(a) RELATING TO CSRS.—Section 8332(o)(2) of title
2
5, United States Code, is amended—
3
(1) in subparagraph (A)—
4
(A) by repealing clause (ii); and
5
(B) in clause (iii)—
6
(i) by striking ‘‘or’’ at the end of sub-
7
clause (I)(bb);
8
(ii) by striking the period at the end
9
of subclause (II)(bb) and inserting ‘‘; or’’;
10
and
11
(iii) by adding after subclause (II) the
12
following:
13
‘‘(III) is committed after the date
14
of enactment of the Trust Returned
15
to the United States Taxpayer Act
16
and is described under subparagraph
17
(B)(xxxii).’’; and
18
(2) in subparagraph (B), by adding at the end
19
the following:
20
‘‘(xxxii)(I) An offense, not otherwise
21
described under this subparagraph, which
22
is a felony under the laws of a State or the
23
United States.

‘‘(II) For purposes of this clause, the
25
term ‘State’ includes the District of Co-

wealth of the Northern Mariana Islands,

and the Virgin Islands.’’.

(b) RELATING TO FERS.—Section 8411(l)(2) of title
5
5, United States Code, is amended—
6
(1) by repealing subparagraph (B); and
7
(2) in subparagraph (C), by striking ‘‘sub-
8
section.’’ and inserting ‘‘subsection, or, in the case
9
of
an
offense
described
in
section
10
8332(o)(2)(B)(xxxii), after the date of enactment of
11
the Trust Returned to the United States Taxpayer
12
Act.’’.

(c) APPLICATION.—For purposes of applying section
14
8332(o) of title 5, United States Code, the amendments
15
made by this section shall apply to any act or omission
16
occurring after the date of enactment of this Act.
