Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Lake Fannin Recre- 4 ation Area Conveyance Act’’. 5 SEC. 2. DEFINITIONS. 6 In this Act: 7 (1) COUNTY.—The term ‘‘County’’ means 8 Fannin County, Texas. 9 VerDate Sep 11 2014 02:08 Jan 15, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S43.IS S43 kjohnson on DSK79L0C42 with BILLS 2 •S 43 IS (2) MAP.—The term ‘‘map’’ means the map en- 1 titled ‘‘Lake Fannin Conveyance’’ and dated Novem- 2 ber 21, 2013. 3 (3) NATIONAL FOREST SYSTEM LAND.—The 4 term ‘‘National Forest System land’’ means the ap- 5 proximately 2,025 acres of National Forest System 6 land generally depicted on the map. 7 (4) SECRETARY.—The term ‘‘Secretary’’ means 8 the Secretary of Agriculture, acting through the 9 Chief of the Forest Service. 10 SEC. 3. LAND CONVEYANCE. 11 (a) IN GENERAL.—Subject to the terms and condi- 12 tions described in subsection (b), if the County submits 13 to the Secretary an offer to acquire the National Forest 14 System land for the fair market value, as determined by 15 the appraisal under subsection (c), the Secretary shall con- 16 vey the National Forest System land to the County. 17 (b) TERMS AND CONDITIONS.—The conveyance 18 under subsection (a) shall be— 19 (1) subject to valid existing rights; 20 (2) made by quitclaim deed; and 21 (3) subject to any other terms and conditions 22 as the Secretary considers appropriate to protect the 23 interests of the United States. 24 (c) APPRAISAL.— 25 VerDate Sep 11 2014 02:08 Jan 15, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S43.IS S43 kjohnson on DSK79L0C42 with BILLS 3 •S 43 IS (1) IN GENERAL.—Not later than 180 days 1 after the date of enactment of this Act, the Sec- 2 retary shall complete an appraisal to determine the 3 fair market value of the National Forest System 4 land. 5 (2) STANDARDS.—The appraisal under para- 6 graph (1) shall be conducted in accordance with— 7 (A) the Uniform Appraisal Standards for 8 Federal Land Acquisitions; and 9 (B) the Uniform Standards of Professional 10 Appraisal Practice. 11 (d) MAP.— 12 (1) AVAILABILITY OF MAP.—The map shall be 13 kept on file and available for public inspection in the 14 appropriate office of the Forest Service. 15 (2) CORRECTION OF ERRORS.—The Secretary 16 may correct minor errors in the map. 17 (e) CONSIDERATION.—As consideration for the con- 18 veyance under subsection (a), the County shall pay to the 19 Secretary an amount equal to the fair market value of the 20 National Forest System land, as determined by the ap- 21 praisal under subsection (c). 22 (f) SURVEY.—The exact acreage and legal description 23 of the National Forest System land to be conveyed under 24 VerDate Sep 11 2014 02:08 Jan 15, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S43.IS S43 kjohnson on DSK79L0C42 with BILLS 4 •S 43 IS subsection (a) shall be determined by a survey satisfactory 1 to the Secretary and the County. 2 (g) USE.—As a condition of the conveyance under 3 subsection (a), the County shall agree to manage the land 4 conveyed under that subsection for public recreational 5 purposes. 6 (h) COSTS OF CONVEYANCE.—As a condition on the 7 conveyance under subsection (a), the County shall pay to 8 the Secretary all costs associated with the conveyance, in- 9 cluding the cost of— 10 (1) the appraisal under subsection (c); and 11 (2) the survey under subsection (f). 12 Æ VerDate Sep 11 2014 02:08 Jan 15, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S43.IS S43 kjohnson on DSK79L0C42 with BILLS
