SHORT TITLE. 1 This Act may be cited as the ‘‘Protecting and Secur- 2 ing Florida’s Coastline Act of 2019’’. 3 SEC. 2. PERMANENT EXTENSION OF MORATORIUM ON 4 LEASING IN CERTAIN AREAS OF THE GULF 5 OF MEXICO. 6 Section 104(a) of the Gulf of Mexico Energy Security 7 Act of 2006 (43 U.S.C. 1331 note) is amended by striking 8 ‘‘Effective during’’ and all that follows through ‘‘the Sec- 9 retary’’ and inserting ‘‘The Secretary’’. 10 SEC. 3. PRODUCTION SAFETY SYSTEMS AND WELL CON- 11 TROL. 12 Subparts D, E, F, G, H, and Q of section 250 of 13 title 30, Code of Federal Regulations (as in effect on Jan- 14 uary 1, 2018), shall have the same force and effect of law 15 as if such subparts had been enacted by an Act of Con- 16 gress. 17 SEC. 4. INSPECTION FEE COLLECTION. 18 Section 22 of the Outer Continental Shelf Lands Act 19 (43 U.S.C. 1348) is amended by adding at the end the 20 following: 21 ‘‘(g) INSPECTION FEES.— 22 ‘‘(1) ESTABLISHMENT.—The Secretary of the 23 Interior shall collect from the operators of facilities 24 subject to inspection under subsection (c) non-re- 25 fundable fees for such inspections— 26 VerDate Sep 11 2014 21:37 Sep 12, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H205.RFS H205 pamtmann on DSKBC07HB2PROD with BILLS 3 HR 205 RFS ‘‘(A) at an aggregate level equal to the 1 amount necessary to offset the annual expenses 2 of inspections of outer Continental Shelf facili- 3 ties (including mobile offshore drilling units) by 4 the Secretary of the Interior; and 5 ‘‘(B) using a schedule that reflects the dif- 6 ferences in complexity among the classes of fa- 7 cilities to be inspected. 8 ‘‘(2) OCEAN ENERGY SAFETY FUND.—There is 9 established in the Treasury a fund, to be known as 10 the ‘Ocean Energy Safety Fund’ (referred to in this 11 subsection as the ‘Fund’), into which shall be depos- 12 ited all amounts collected as fees under paragraph 13 (1) and which shall be available as provided under 14 paragraph (3). 15 ‘‘(3) AVAILABILITY OF FEES.—Notwithstanding 16 section 3302 of title 31, United States Code, all 17 amounts deposited in the Fund— 18 ‘‘(A) shall be credited as offsetting collec- 19 tions; 20 ‘‘(B) shall be available for expenditure for 21 purposes of carrying out inspections of outer 22 Continental Shelf facilities (including mobile 23 offshore drilling units) and the administration 24 of the inspection program under this section; 25 VerDate Sep 11 2014 21:37 Sep 12, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H205.RFS H205 pamtmann on DSKBC07HB2PROD with BILLS 4 HR 205 RFS ‘‘(C) shall be available only to the extent 1 provided for in advance in an appropriations 2 Act; and 3 ‘‘(D) shall remain available until expended. 4 ‘‘(4) ADJUSTMENT FOR INFLATION.—For each 5 fiscal year beginning after fiscal year 2020, the Sec- 6 retary shall adjust each dollar amount specified in 7 this subsection for inflation based on the change in 8 the Consumer Price Index from fiscal year 2020. 9 ‘‘(5) ANNUAL FEES.—Annual fees shall be col- 10 lected under this subsection for facilities that are 11 above the waterline, excluding drilling rigs, and are 12 in place at the start of the fiscal year. Fees for fiscal 13 year 2020 shall be— 14 ‘‘(A) $11,500 for facilities with no wells, 15 but with processing equipment or gathering 16 lines; 17 ‘‘(B) $18,500 for facilities with 1 to 10 18 wells, with any combination of active or inactive 19 wells; and 20 ‘‘(C) $34,500 for facilities with more than 21 10 wells, with any combination of active or in- 22 active wells. 23 ‘‘(6) FEES FOR DRILLING RIGS.—Fees shall be 24 collected under this subsection for drilling rigs on a 25 VerDate Sep 11 2014 21:37 Sep 12, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H205.RFS H205 pamtmann on DSKBC07HB2PROD with BILLS 5 HR 205 RFS per inspection basis. Fees for fiscal year 2020 shall 1 be— 2 ‘‘(A) $33,500 per inspection for rigs oper- 3 ating in water depths of 500 feet or more; and 4 ‘‘(B) $18,500 per inspection for rigs oper- 5 ating in water depths of less than 500 feet. 6 ‘‘(7) FEES FOR NON-RIG UNITS.—Fees shall be 7 collected under this subsection for well operations 8 conducted via non-rig units as outlined in subparts 9 D, E, F, and Q of part 250 of title 30, Code of Fed- 10 eral Regulations, on a per inspection basis. Fees for 11 fiscal year 2020 shall be— 12 ‘‘(A) $13,260 per inspection for non-rig 13 units operating in water depths of 2,500 feet or 14 more; 15 ‘‘(B) $11,530 per inspection for non-rig 16 units operating in water depths between 500 17 and 2,499 feet; and 18 ‘‘(C) $4,470 per inspection for non-rig 19 units operating in water depths of less than 500 20 feet. 21 ‘‘(8) BILLING.—The Secretary shall bill des- 22 ignated operators under paragraph (5) annually, 23 with payment required within 30 days of billing. DETERMINATION OF BUDGETARY EFFECTS. 4 The budgetary effects of this Act, for the purpose of 5 complying with the Statutory Pay-As-You-Go Act of 2010, 6 shall be determined by reference to the latest statement 7 titled ‘‘Budgetary Effects of PAYGO Legislation’’ for this 8 Act, submitted for printing in the Congressional Record 9 by the Chairman of the House Budget Committee, pro- 10 vided that such statement has been submitted prior to the 11 vote on passage. 12 SEC. 6.
