SHORT TITLE. 3 This Act may be cited as the ‘‘Columbia River In- 4 Lieu and Treaty Fishing Access Sites Improvement Act’’. 5 SEC. 2. SANITATION AND SAFETY CONDITIONS AT CERTAIN 6 BUREAU OF INDIAN AFFAIRS FACILITIES. 7 (a) ASSESSMENT OF CONDITIONS.—The Secretary of 8 the Interior, acting through the Bureau of Indian Affairs, 9 in consultation with the affected Columbia River Treaty 10 tribes, may assess current sanitation and safety conditions 11 on lands held by the United States for the benefit of the 12 affected Columbia River Treaty tribes, including all per- 13 manent Federal structures and improvements on those 14 lands, that were set aside to provide affected Columbia 15 River Treaty tribes access to traditional fishing grounds— 16 (1) in accordance with the Act of March 2, 17 1945 (59 Stat. 10, chapter 19) (commonly known as 18 the ‘‘River and Harbor Act of 1945’’); or 19 (2) in accordance with title IV of Public Law 20 100–581 (102 Stat. 2944). 21 (b) EXCLUSIVE AUTHORIZATION; CONTRACTS.—The 22 Secretary of the Interior, acting through the Bureau of 23 Indian Affairs— 24 VerDate Sep 11 2014 22:40 Apr 30, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H91.RFS H91 kjohnson on DSK79L0C42 with BILLS 3 HR 91 RFS (1) subject to paragraph (2)(B), shall be the 1 only Federal agency authorized to carry out the ac- 2 tivities described in this section; and 3 (2) may delegate the authority to carry out ac- 4 tivities described in paragraphs (1) and (2) of sub- 5 section (d)— 6 (A) through one or more contracts entered 7 into with an Indian Tribe or Tribal organiza- 8 tion under the Indian Self-Determination and 9 Education Assistance Act (25 U.S.C. 5301 et 10 seq.); or 11 (B) to include other Federal agencies that 12 have relevant expertise. 13 (c) DEFINITION OF AFFECTED COLUMBIA RIVER 14 TREATY TRIBES.—In this section, the term ‘‘affected Co- 15 lumbia River Treaty tribes’’ means the Nez Perce Tribe, 16 the Confederated Tribes of Umatilla Indian Reservation, 17 the Confederated Tribes of the Warm Springs Reservation 18 of Oregon, and the Confederated Tribes and Bands of the 19 Yakama Nation. 20 (d) AUTHORIZATION OF APPROPRIATIONS.—There 21 are authorized to be appropriated to the Secretary of the 22 Interior such sums as are necessary, to remain available 23 until expended— 24 VerDate Sep 11 2014 22:40 Apr 30, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H91.RFS H91 kjohnson on DSK79L0C42 with BILLS 4 HR 91 RFS (1) for improvements to existing structures and 1 infrastructure to improve sanitation and safety con- 2 ditions assessed under subsection (a); and 3 (2) to improve access to electricity, sewer, and 4 water infrastructure, where feasible, to reflect needs 5 for sanitary and safe use of facilities referred to in 6 subsection (a). 7 SEC. 3.
