Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Carson City Mint 4 150th Anniversary Commemorative Coin Act of 2019’’. 5 SEC. 2. FINDINGS. 6 The Congress finds the following: 7 (1) The Carson City Mint played an important 8 role in the founding of the Great American West. 9 VerDate Sep 11 2014 00:22 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H61.IH H61 pbinns on DSK79D2C42PROD with BILLS 2 •HR 61 IH (2) Congress established the Carson City Mint 1 in 1863 to serve the coinage needs brought on by 2 the Comstock Lode during the silver rush in Ne- 3 vada. 4 (3) The Carson City Mint was designed by Al- 5 fred Mullett, the supervising architect for the United 6 States Department of the Treasury. 7 (4) The brick used to construct the Carson City 8 Mint was manufactured at the Adams Brick Works 9 in Genoa, operated by the grandsons of John Quincy 10 Adams. 11 (5) The opening of the Carson City Mint was 12 delayed due to the Civil War. 13 (6) The Carson City Mint opened in December 14 of 1869, and produced its first coins on February 15 11, 1870. 16 (7) Coins struck at the Carson City Mint were 17 distinguished by the ‘‘CC’’ mint mark. 18 (8) The Carson City Mint coined more than 19 $49,000,000 of silver and gold. 20 (9) The Carson City Mint ended coin produc- 21 tion in 1893, due to reduced mining of the Comstock 22 Lode. 23 (10) The Carson City Mint is listed on the Na- 24 tional Register of Historic Places. 25 VerDate Sep 11 2014 00:22 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H61.IH H61 pbinns on DSK79D2C42PROD with BILLS 3 •HR 61 IH SEC. 3. COIN SPECIFICATIONS. 1 (a) DENOMINATIONS.—Notwithstanding any other 2 provision of law, and in commemoration of the Carson 3 City Mint’s 150th Anniversary, the Secretary of the 4 Treasury (hereinafter in this Act referred to as the ‘‘Sec- 5 retary’’) shall mint and issue the following coins: 6 (1) $5 GOLD COINS.—Not more than 100,000 7 $5 coins, which shall— 8 (A) weigh 8.359 grams; 9 (B) have a diameter of 0.850 inches; and 10 (C) contain 90 percent gold and 10 percent 11 alloy. 12 (2) $1 SILVER COINS.—Not more than 500,000 13 $1 coins, which shall— 14 (A) weigh 26.73 grams; 15 (B) have a diameter of 1.500 inches; and 16 (C) contain not less than 90 percent silver. 17 (b) LEGAL TENDER.—The coins minted under this 18 Act shall be legal tender, as provided in section 5103 of 19 title 31, United States Code. 20 (c) NUMISMATIC ITEMS.—For purposes of sections 21 5134 and 5136 of title 31, United States Code, all coins 22 minted under this Act shall be considered to be numis- 23 matic items. 24 VerDate Sep 11 2014 00:22 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H61.IH H61 pbinns on DSK79D2C42PROD with BILLS 4 •HR 61 IH SEC. 4. DESIGN OF COINS. 1 (a) IN GENERAL.—The design of the coins minted 2 under this Act shall be emblematic of the Carson City 3 Mint building, its importance to Nevada and the Nation’s 4 history, and its 150th anniversary. 5 (b) DESIGNATION AND INSCRIPTIONS.—On each coin 6 minted under this Act, there shall be— 7 (1) a designation of the value of the coin; 8 (2) an inscription of the year ‘‘2020’’; and 9 (3) inscriptions of the words ‘‘Liberty’’, ‘‘In 10 God We Trust’’, ‘‘United States of America’’, and 11 ‘‘E Pluribus Unum’’. 12 (c) SELECTION.—The design for the coins minted 13 under this Act shall be— 14 (1) selected by the Secretary, after consultation 15 with the Nevada State Museum Dedicated Trust 16 Fund; 17 (2) reviewed by the Citizens Coinage Advisory 18 Committee; and 19 (3) selected in a timely fashion, which allows 20 for the minting of such coins to begin as quickly as 21 possible. 22 SEC. 5. ISSUANCE OF COINS. 23 (a) QUALITY OF COINS.—Coins minted under this 24 Act shall be issued in uncirculated and proof qualities. 25 VerDate Sep 11 2014 00:22 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H61.IH H61 pbinns on DSK79D2C42PROD with BILLS 5 •HR 61 IH (b) PERIOD FOR ISSUANCE.—The Secretary may 1 issue coins minted under this Act only during the 1-year 2 period beginning on January 1, 2020. 3 SEC. 6. SALE OF COINS. 4 (a) SALE PRICE.—The coins issued under this Act 5 shall be sold by the Secretary at a price equal to the sum 6 of— 7 (1) the face value of the coins; 8 (2) the surcharge provided in section 7(a) with 9 respect to such coins; and 10 (3) the cost of designing and issuing the coins 11 (including labor, materials, dies, use of machinery, 12 overhead expenses, marketing, and shipping). 13 (b) BULK SALES.—The Secretary shall make bulk 14 sales of the coins issued under this Act at a reasonable 15 discount. 16 (c) PREPAID ORDERS.— 17 (1) IN GENERAL.—The Secretary shall accept 18 prepaid orders for the coins minted under this Act 19 before the issuance of such coins. 20 (2) DISCOUNT.—Sale prices with respect to pre- 21 paid orders under paragraph (1) shall be at a rea- 22 sonable discount. 23 VerDate Sep 11 2014 00:22 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H61.IH H61 pbinns on DSK79D2C42PROD with BILLS 6 •HR 61 IH SEC. 7. SURCHARGES. 1 (a) IN GENERAL.—All sales of coins minted under 2 this Act shall include a surcharge as follows: 3 (1) A surcharge of $35 per coin for the $5 coin. 4 (2) A surcharge of $10 per coin for the $1 coin. 5 (b) DISTRIBUTION.—Subject to section 5134(f) of 6 title 31, United States Code, all surcharges received by 7 the Secretary from the sale of coins issued under this Act 8 shall be promptly paid to the Nevada State Museum Dedi- 9 cated Trust Fund, for the purpose of supporting the Ne- 10 vada State Museum mission. 11 (c) AUDITS.—The Nevada State Museum Dedicated 12 Trust Fund shall be subject to the audit requirements of 13 section 5134(f)(2) of title 31, United States Code, with 14 regard to the amounts received under subsection (b). 15 (d) LIMITATION.—Notwithstanding subsection (a), 16 no surcharge may be included with respect to the issuance 17 under this Act of any coin during a calendar year if, as 18 of the time of such issuance, the issuance of such coin 19 would result in the number of commemorative coin pro- 20 grams issued during such year to exceed the annual com- 21 memorative coin program issuance limitation under sec- 22 tion 5112(m)(1) of title 31, United States Code (as in ef- 23 fect on the date of the enactment of this Act). FINANCIAL ASSURANCES. 1 The Secretary shall take such actions as may be nec- 2 essary to ensure that— 3 (1) minting and issuing coins under this Act 4 will not result in a net cost to the United States 5 Government; and 6 (2) no funds, including applicable surcharges, 7 are disbursed to the recipient designated in section 8 7 until the total cost of designing and issuing all of 9 the coins authorized by this Act (including labor, 10 materials, dies, use of machinery, overhead expenses, 11 marketing, and shipping) is recovered by the United 12 States Treasury, consistent with sections 5112(m) 13 and 5134(f) of title 31, United States Code. 14 Æ VerDate Sep 11 2014 00:22 Jan 11, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6301 E:\BILLS\H61.IH H61 pbinns on DSK79D2C42PROD with BILLS
