Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROHIBITING PAY OF MEMBERS OF CONGRESS IN 1 RESPONSE TO GOVERNMENT SHUTDOWN. 2 (a) PROHIBITION OF PAY.—If on any day during a 3 pay period a Government shutdown is in effect, the payroll 4 administrator of each House of Congress shall exclude 5 from the payments otherwise required to be made with re- 6 spect to that pay period for the compensation of each 7 Member of Congress who serves in that House of Congress 8 an amount equal to the product of— 9 (1) an amount equal to one day’s worth of pay 10 under the annual rate of pay applicable to the Mem- 11 ber under section 601(a) of the Legislative Reorga- 12 nization Act of 1946 (2 U.S.C. 4501); and 13 (2) the number of 24-hour periods during which 14 the Government shutdown is in effect which occur 15 during the pay period. 16 (b) ROLE OF SECRETARY OF THE TREASURY.—The 17 Secretary of the Treasury shall provide the payroll admin- 18 istrators of the Houses of Congress with such assistance 19 as may be necessary to enable the payroll administrators 20 to carry out this section. 21 (c) PAYROLL ADMINISTRATOR DEFINED.—In this 22 section, the ‘‘payroll administrator’’ of a House of Con- 23 gress means— 24 (1) in the case of the House of Representatives, 25 the Chief Administrative Officer of the House of 26 VerDate Sep 11 2014 00:50 Jan 08, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H26.IH H26 kjohnson on DSK79L0C42 with BILLS 3 •HR 26 IH Representatives, or an employee of the Office of the 1 Chief Administrative Officer who is designated by 2 the Chief Administrative Officer to carry out this 3 section; and 4 (2) in the case of the Senate, the Secretary of 5 the Senate, or an employee of the Office of the Sec- 6 retary of the Senate who is designated by the Sec- 7 retary to carry out this section. 8 (d) EFFECTIVE DATE.—This section shall apply with 9 respect to days occurring during the One Hundred Seven- 10 teenth Congress and each succeeding Congress. 11 SEC. 3. DETERMINATION OF GOVERNMENT SHUTDOWN. 12 For purposes of this Act, a Government shutdown 13 shall be considered to be in effect if there is a lapse in 14 appropriations for any Federal agency or department as 15 a result of a failure to enact a regular appropriations bill 16 or continuing resolution. 17 SEC. 4.
