A BILL
To direct the Secretary of Energy to fund projects to restore
and modernize National Laboratories, and for other pur-
poses.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Restore and Modernize
4
Our National Laboratories Act of 2021’’.

SEC. 2. NATIONAL LABORATORIES RESTORATION AND
6
MODERNIZATION.

(a) DEFINITIONS.—In this section:

(1) NATIONAL LABORATORY.—The term ‘‘Na-
1
tional Laboratory’’ has the meaning given the term
2
in section 2 of the Energy Policy Act of 2005 (42
3
U.S.C. 15801).

(2) SECRETARY.—The term ‘‘Secretary’’ means
5
the Secretary of Energy.

(b)
RESTORATION
AND
MODERNIZATION
7
PROJECTS.—The Secretary shall fund projects described
8
in subsection (c) as needed to address the deferred mainte-
9
nance, critical infrastructure needs, and modernization of
10
National Laboratories.

(c) PROJECTS DESCRIBED.—The projects referred to
12
in subsection (b) are, as determined by the Secretary—
13
(1) priority deferred maintenance projects at
14
National
Laboratories,
including
facilities
15
sustainment for, upgrade of, and construction of re-
16
search laboratories, administrative and support
17
buildings, utilities, roads, power plants, and any
18
other critical infrastructure; and
19
(2) lab modernization projects at National Lab-
20
oratories, including lab modernization projects relat-
21
ing to core infrastructure needed—
22
(A) to support existing and emerging
23
science missions with new and specialized re-

quirements for world-leading scientific user fa-
1
cilities and computing capabilities; and
2
(B) to maintain safe, efficient, reliable,
3
and environmentally responsible operations.

(d) SUBMISSION TO CONGRESS.—For each fiscal year
5
through fiscal year 2025, at the same time as the annual
6
budget submission of the President, the Secretary shall
7
submit to the Committees on Appropriations and Energy
8
and Natural Resources of the Senate and the Committees
9
on Appropriations and Science, Space, and Technology of
10
the House of Representatives a list of projects for which
11
the Secretary will provide funding under this section, in-
12
cluding a description of each project and the funding pro-
13
file for the project.

(e) AUTHORIZATION OF APPROPRIATIONS.—
15
(1) IN GENERAL.—There is authorized to be
16
appropriated to the Secretary to carry out this sec-
17
tion $6,100,000,000 for each of fiscal years 2022
18
through 2025.

(2) OFFICE OF SCIENCE.—Not less than 1⁄6 of
20
the amounts made available to carry out this section
21
each fiscal year shall be managed by the Office of
22
Science of the Department of Energy.
