SHORT TITLE. 1 This Act may be cited as the ‘‘Protect Older Job Ap- 2 plicants Act of 2021’’ or ‘‘POJA Act of 2021’’. 3 SEC. 2. PROHIBITION AGAINST LIMITING, SEGREGATING, 4 OR CLASSIFYING APPLICANTS FOR EMPLOY- 5 MENT. 6 Section 4(a)(2) of the Age Discrimination in Employ- 7 ment Act of 1967 (29 U.S.C. 623(a)(2)) is amended— 8 (1) by inserting ‘‘or applicants for employment’’ 9 after ‘‘employees’’; and 10 (2) by inserting ‘‘or as an applicant for employ- 11 ment’’ after ‘‘employee’’. 12 SEC. 3. STUDY. 13 Not later than 1 year after the date of the enactment 14 of this Act, the Equal Employment Opportunity Commis- 15 sion shall conduct a study to determine the number of 16 claims pending or filed with the Commission since 2015 17 under the Age Discrimination in Employment Act of 1967 18 (29 U.S.C. 621 et seq.), including claims in closed cases, 19 by job applicants who may have been adversely impacted 20 by age discrimination in the job application process.
