SHORT TITLE. 3 This Act may be cited as the ‘‘Collecting and Ana- 4 lyzing Resources Integral and Necessary for Guidance for 5 Social Determinants Act of 2021’’ or the ‘‘CARING for 6 Social Determinants Act of 2021’’. 7 SEC. 2. REQUIREMENT TO ISSUE GUIDANCE TO CLARIFY 8 STRATEGIES TO ADDRESS SOCIAL DETER- 9 MINANTS OF HEALTH IN THE MEDICAID PRO- 10 GRAM AND THE CHILDREN’S HEALTH INSUR- 11 ANCE PROGRAM. 12 Not later than 3 years after the date of the enact- 13 ment of this Act, and not less frequently than once every 14 3 years thereafter, the Secretary of Health and Human 15 Services shall update the State Health Office letter 21- 16 001, issued on January 7, 2021, to clarify strategies to 17 address social determinants of health under the Medicaid 18 program and the Children’s Health Insurance Program. 19 Such update shall include the following: 20 (1) Guidance to State Medicaid agencies re- 21 garding the strategies that States can implement 22 under authorities in existence as of such update 23 under title XIX of the Social Security Act, title XXI 24 of such Act, or section 1115 of such Act to address 25 VerDate Sep 11 2014 03:15 Dec 10, 2021 Jkt 029200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3894.RFS H3894 pbinns on DSKJLVW7X2PROD with BILLS 3 HR 3894 RFS social determinants of health in the provision of 1 health care, including strategies specifically tar- 2 geting children receiving medical assistance under a 3 State plan under title XIX of such Act (or a waiver 4 of such plan) or child health assistance under a 5 State child health plan under title XXI of such Act. 6 (2) Guidance on how States can encourage and 7 incentivize managed care entities to address social 8 determinants of health through contracts with such 9 entities. 10 (3) Updated examples from States with respect 11 to how States are addressing social determinants of 12 health in the provision of health care under the Med- 13 icaid program under title XIX of the Social Security 14 Act and the Children’s Health Insurance Program 15 under title XXI of such Act, including through pay- 16 ment models. 17 Passed the House of Representatives December 8, 2021.
