CLYDE, Mr. BURCHETT, Mr. DUNCAN, Mr. GOSAR, and Mr. MOONEY) in-
troduced the following bill; which was referred to the Committee on
Armed Services
A BILL
To prohibit any requirement that a member of the Armed
Forces receive a vaccination against COVID-19.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. PROHIBITIONS ON REQUIREMENT THAT A
3
MEMBER OF THE ARMED FORCES RECEIVE A
4
VACCINATION AGAINST COVID-19.
5
(a) PROHIBITION ON FUNDING.—No Federal funds
6
may be used to require a member of the Armed Forces
7
to receive a vaccination against COVID-19.

(b) PROHIBITION ON ADVERSE ACTION.—The Sec-
1
retary concerned may not take any adverse action against
2
a member of the Armed Forces because such member re-
3
fuses to receive a vaccination against COVID-19.
4
(c) DEFINITIONS.—In this section:
5
(1) The term ‘‘adverse action’’ includes the fol-
6
lowing:
7
(A) Retaliation.
8
(B) Punishment.
9
(C) Disparate treatment.
10
(D) A requirement to wear a mask.
11
(E) A requirement to reside in sub-
12
standard housing.
13
(2) The term ‘‘Secretary concerned’’ has the
14
meaning given that term in section 101 of title 10,
15
United States Code.
