Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Renter Protection Act 4 of 2021’’. 5 SEC. 2. EMERGENCY RENTAL ASSISTANCE. 6 (a) ARPA FUNDS.—Notwithstanding any incon- 7 sistent provision of section 3201 of the American Rescue 8 VerDate Sep 11 2014 23:04 Jul 15, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3913.IH H3913 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 3913 IH Plan Act of 2021 (15 U.S.C. 9058c(a)(1)), amounts made 1 available under subsection (a)(1) of such section shall be 2 subject to the following requirements: 3 (1) PAYMENT.—Any amounts allocated to an 4 eligible grantee that, as of July 1, 2021, have not 5 been paid to the eligible grantee shall be paid (but 6 not reallocated) to the eligible grantee in accordance 7 with section 501(b) of subtitle A of title V of divi- 8 sion N of the Consolidated Appropriations Act, 2021 9 (15 U.S.C. 9058a(b)), except that such section 10 501(b)(1)(A)(i) shall be applied to such amounts by 11 substituting ‘‘the Renter Protection Act of 2021’’ 12 for ‘‘this section’’. 13 (2) USE FOR RENTAL ARREARS; TREATMENT.— 14 Any amounts described in paragraph (1) and any 15 amounts that have been paid to an eligible grantee 16 under such section 3201 but have not been used, as 17 of July 1, 2021, to assist an eligible household, shall 18 be— 19 (A) used only to provide financial assist- 20 ance specified in paragraph (6) of section 21 501(c) of subtitle A of title V of division N of 22 the Consolidated Appropriations Act, 2021 (15 23 U.S.C. 9058a(c)(6)), as added by subsection (b) 24 of this section; and 25 VerDate Sep 11 2014 23:04 Jul 15, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3913.IH H3913 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 3913 IH (B) treated as having been paid to such el- 1 igible grantee pursuant to such section 501(a) 2 and shall be subject to the provisions of such 3 section 501, as amended by this section, except 4 to the extent inconsistent with this section. 5 (b) REQUIREMENT TO USE CONSOLIDATED APPRO- 6 PRIATIONS ACT FUNDS FOR RENTAL ARREARS.—Sub- 7 section (c) of section 501 of subtitle A of title V of division 8 N of the Consolidated Appropriations Act, 2021 (15 9 U.S.C. 9058a(c)), is amended by adding at the end the 10 following new paragraph: 11 ‘‘(6) REQUIREMENT TO USE ASSISTANCE FOR 12 RENTAL ARREARS.—Notwithstanding any other pro- 13 vision of this subsection, effective July 1, 2021, any 14 funds paid to an eligible grantee pursuant to sub- 15 section (a) that have not been used to assist an eligi- 16 ble household shall be used only to provide financial 17 assistance to eligible households solely for the pay- 18 ment of rent arrears under paragraph (2)(A)(ii) of 19 this subsection.’’. 20 (c) AVAILABILITY OF FUNDS.—Paragraph (1) of sec- 21 tion 501(e) of subtitle A of title V of division N of the 22 Consolidated Appropriations Act, 2021 (15 U.S.C. 23 VerDate Sep 11 2014 23:04 Jul 15, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3913.IH H3913 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 3913 IH 9058a(e)(1)), is amended by striking ‘‘September 30, 1 2022’’ and inserting ‘‘December 31, 2021’’. 2 Æ VerDate Sep 11 2014 23:04 Jul 15, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3913.IH H3913 pamtmann on DSKBC07HB2PROD with BILLS
