Taylor. Whereas, in the case of United States v. Taylor, Cr. No. 21– 6, pending in the United States District Court for the Western District of Virginia, the prosecution has re- quested the production of testimony and, if necessary, documents from Nicole Meservey, an employee of the of- fice of Senator Mark Warner; Whereas, pursuant to sections 703(a) and 704(a)(2) of the Ethics in Government Act of 1978, 2 U.S.C. §§ 288b(a) and 288c(a)(2), the Senate may direct its counsel to rep- resent current and former employees of the Senate with respect to any subpoena, order, or request for testimony or documents relating to their official responsibilities; VerDate Sep 11 2014 23:48 Jun 08, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6300 E:\BILLS\SR263.ATS SR263 kjohnson on DSK79L0C42PROD with BILLS 2 SRES 263 ATS Whereas, by the privileges of the Senate of the United States and Rule XI of the Standing Rules of the Senate, no evi- dence under the control or in the possession of the Sen- ate may, by the judicial or administrative process, be taken from such control or possession but by permission of the Senate; and Whereas, when it appears that evidence under the control or in the possession of the Senate may promote the adminis- tration of justice, the Senate will take such action as will promote the ends of justice consistent with the privileges of the Senate: Now, therefore, be it Resolved, That Nicole Meservey, an employee of the 1 office of Senator Mark Warner, and any other current or 2 former employee of the Senator’s office from whom rel- 3 evant evidence may be necessary, are authorized to testify 4 and produce documents in the case of United States v. 5 Taylor, except concerning matters for which a privilege 6 should be asserted. 7 SEC. 2.
