Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. INDIAN HEALTH SERVICE SANITATION FACILI- 3 TIES CONSTRUCTION PROGRAM FUNDING. 4 (a) FINDINGS.—Congress finds that— 5 (1) the COVID–19 crisis has highlighted the 6 lack of infrastructure and sanitation available in Na- 7 tive communities; and 8 VerDate Sep 11 2014 23:52 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S1895.IS S1895 kjohnson on DSK79L0C42PROD with BILLS 2 •S 1895 IS (2) addressing the Sanitation Facilities Defi- 1 ciency List of the Division of Sanitation Facilities 2 and Construction of the Indian Health Service in- 3 cluded in the Sanitation Deficiency System will— 4 (A) result in investments in necessary 5 water infrastructure; and 6 (B) improve health outcomes. 7 (b) DEFINITIONS.—In this section: 8 (1) SANITATION DEFICIENCY SYSTEM.—The 9 term ‘‘Sanitation Deficiency System’’ means the sys- 10 tem established by the Secretary under section 11 302(g) of the Indian Health Care Improvement Act 12 (25 U.S.C. 1632(g)) to identify, report, and 13 prioritize the sanitation deficiencies of Indian Tribes 14 and communities. 15 (2) SECRETARY.—The term ‘‘Secretary’’ means 16 the Secretary of Health and Human Services, acting 17 through the Director of the Indian Health Service. 18 (c) ADDITIONAL FUNDING FOR SANITATION FACILI- 19 TIES.— 20 (1) IN GENERAL.—The Secretary shall award 21 additional funding under the Sanitation Facilities 22 Construction Program for the planning, design, con- 23 struction, modernization, improvement, and renova- 24 tion of water, sewer, and solid waste sanitation fa- 25 VerDate Sep 11 2014 23:52 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1895.IS S1895 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1895 IS cilities that are funded, in whole or part, by the In- 1 dian Health Service— 2 (A) through, or provided for in, a contract 3 or compact with the Indian Health Service 4 under the Indian Self-Determination and Edu- 5 cation Assistance Act (25 U.S.C. 5301 et seq.); 6 (B) pursuant to section 7 of the Act of Au- 7 gust 5, 1954 (68 Stat. 674, chapter 658; 73 8 Stat. 267; 42 U.S.C. 2004a); and 9 (C) pursuant to section 302 of the Indian 10 Health Care Improvement Act (25 U.S.C. 11 1632). 12 (2) PRIORITY FOR FUNDING.—In awarding 13 funding to sanitation facilities under paragraph (1), 14 the Secretary shall prioritize sanitation facilities in 15 accordance with the Sanitation Deficiency System. 16 (d) AUTHORIZATION OF APPROPRIATIONS.— 17 (1) IN GENERAL.—There is authorized to be 18 appropriated to the Secretary to carry out this sec- 19 tion $3,000,000,000 for fiscal year 2022, to remain 20 available until expended. 21 (2) ADDITIONAL SUPPORT.— Of the funds ap- 22 propriated under paragraph (1), $350,000,000 shall 23 be for additional staffing support to carry out this 24 section. 25 VerDate Sep 11 2014 23:52 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1895.IS S1895 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1895 IS (3) REQUIREMENT.—Amounts made available 1 under paragraph (1) shall be in addition to any 2 amounts made available to carry out the purposes 3 described in subsection (c)(1) under any other provi- 4 sion of law. 5 Æ VerDate Sep 11 2014 23:52 Jun 15, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S1895.IS S1895 kjohnson on DSK79L0C42PROD with BILLS
