Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROHIBITION ON SHIPPING, TRANSPORTING, MOV- 1 ING, DELIVERING, RECEIVING, POSSESSING, 2 PURCHASING, SELLING, OR DONATION OF 3 HORSES AND OTHER EQUINES FOR SLAUGH- 4 TER FOR HUMAN CONSUMPTION. 5 (a) DEFINITIONS.—Section 2 of the Horse Protection 6 Act (15 U.S.C. 1821) is amended— 7 (1) by redesignating paragraphs (1) and (4) as 8 paragraphs (2), and (5), respectively; 9 (2) by inserting before paragraph (2), as so re- 10 designated, the following new paragraph: 11 ‘‘(1) The term ‘human consumption’ means ingestion 12 by people as a source of food.’’; and 13 (3) by inserting after paragraph (3), as so re- 14 designated, the following new paragraph: 15 ‘‘(4) The term ‘slaughter’ means the killing of one 16 or more horses or other equines with the intent to sell 17 or trade the flesh of such horses or equines for human 18 consumption.’’. 19 (b) FINDINGS.—Section 3 of the Horse Protection 20 Act (15 U.S.C. 1822) is amended— 21 (1) by redesignating paragraphs (1) through 22 (5) as paragraphs (6) through (10), respectively; 23 (2) by inserting before paragraph (6), as so re- 24 designated, the following new paragraphs: 25 VerDate Sep 11 2014 17:42 Jun 30, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3355.IH H3355 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 3355 IH ‘‘(1) horses and other equines play a vital role 1 in the collective experience of the United States and 2 deserve protection and compassion; 3 ‘‘(2) horses and other equines are domestic ani- 4 mals that are used primarily for recreation, pleasure, 5 work, and sport; 6 ‘‘(3) unlike cows, pigs, and many other animals, 7 horses and other equines are not raised for the pur- 8 pose of being slaughtered for human consumption; 9 ‘‘(4) individuals selling horses or other equines 10 at auctions are seldom aware that the animals may 11 be bought for the purpose of being slaughtered for 12 human consumption;’’; and 13 (3) by striking paragraph (8), as so redesig- 14 nated, and inserting the following new paragraph: 15 ‘‘(8) the shipping, transporting, moving, deliv- 16 ering, receiving, possessing, purchasing, selling, or 17 donation in intrastate commerce of horses and other 18 equines to be slaughtered for human consumption, 19 adversely affects and burdens interstate and foreign 20 commerce;’’. 21 (c) PROHIBITION.—Section 5 of the Horse Protection 22 Act (15 U.S.C. 1824) is amended— 23 VerDate Sep 11 2014 17:42 Jun 30, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3355.IH H3355 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 3355 IH (1) by redesignating paragraphs (8) through 1 (11) as paragraphs (9) through (12), respectively; 2 and 3 (2) by inserting after paragraph (7) the fol- 4 lowing new paragraph: 5 ‘‘(8) The shipping, transporting, moving, deliv- 6 ering, receiving, possessing, purchasing, selling, or 7 donation by a person of any horse or other equine 8 that the person has reason to believe will be slaugh- 9 tered for human consumption.’’. 10 Æ VerDate Sep 11 2014 17:42 Jun 30, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3355.IH H3355 pamtmann on DSKBC07HB2PROD with BILLS
