Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. FORFEITURE OF PENSION. 1 Section 8332(o) of title 5, United States Code, is 2 amended by adding at the end the following: 3 ‘‘(7)(A) Subject to subparagraph (B), an individual 4 convicted of an offense described in paragraph (2) shall 5 not, between the date of sentencing and the date of final 6 conviction for such offense, be eligible to receive any pay- 7 ment of an annuity pursuant to the retirement system 8 under this subchapter or chapter 84, except that this sen- 9 tence applies only to such payments based on service ren- 10 dered as a Member (irrespective of when rendered). 11 ‘‘(B) If the conviction of an individual described in 12 subparagraph (A) is overturned by a court of competent 13 jurisdiction, such individual shall receive payments that 14 such individual would have received but for application of 15 subparagraph (A). 16 ‘‘(C) The provisions of this paragraph only apply to 17 a conviction that occurs after the date of enactment of 18 this paragraph.’’. 19 Æ VerDate Sep 11 2014 02:21 May 20, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H3327.IH H3327 pbinns on DSKJLVW7X2PROD with BILLS
