Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Iran China Account- 4 ability Act’’. 5 SEC. 2. FINDINGS. 6 Congress finds the following: 7 VerDate Sep 11 2014 05:36 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3465.IH H3465 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 3465 IH (1) The 2015 Joint Comprehensive Plan of Ac- 1 tion (JCPOA) provided Iran with over 2 $100,000,000,000 in sanctions relief, circumventing 3 mandatory sanctions imposed by the Congress of the 4 United States. 5 (2) The Obama Administration delivered 6 $400,000,000 in cash to Iran in 2016. 7 (3) President Trump wisely removed the United 8 States from the disastrous JCPOA on May 8, 2018, 9 and implemented a campaign of maximum economic 10 pressure on Iran until the regime ends its nuclear 11 program, its pursuit of ballistic missiles, its support 12 of terrorism and regional destabilization, and re- 13 leases all United States hostages. 14 (4) Iran and China signed a 25-year strategic 15 economic cooperation agreement on March 27, 2021. 16 (5) This agreement involves a transfer of 17 $400,000,000,000 from the Chinese Communist 18 Party to the Iranian Government. 19 (6) The Chinese Communist Party is commit- 20 ting an ongoing genocide against Uighur Muslims in 21 the Xinjiang region and suppressing religious free- 22 dom across the country. 23 (7) The Chinese Communist Party is also sup- 24 pressing religious freedom by wrongly imprisoning 25 VerDate Sep 11 2014 05:36 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3465.IH H3465 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3465 IH Christians, raiding house churches, and attempting 1 to shut down houses of worship not endorsed by the 2 government. 3 (8) The Iranian government is perpetrating vio- 4 lence against its own people, including through the 5 killing of protesters, and the persecution of women 6 and religious minorities. It is also involved in severe 7 violations of human rights throughout the Middle 8 East, including supporting the brutal Assad regime 9 in Syria. 10 (9) China has increased its purchases of oil 11 from Iran, in violation of United States sanctions, in 12 the past few months. Such oil sales would be per- 13 mitted if the United States lifts sanctions on Iran 14 and re-enters the failed Iran nuclear deal. 15 (10) The failed Iran nuclear deal required that 16 the United Nations arms embargo on Iran expire in 17 October 2020, which permits China to sell arms to 18 Iran, and permits Iran to sell arms to China. 19 (11) The United States Government unequivo- 20 cally condemns the Hamas-incited terrorist attacks 21 originating from Israeli land currently occupied by 22 Hamas. 23 VerDate Sep 11 2014 05:36 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3465.IH H3465 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3465 IH (12) The United States Government recognizes 1 Israel’s right to defend itself from Hamas-incited 2 terrorist attacks. 3 SEC. 3. LIMITATIONS WITH RESPECT TO ANY IRAN NU- 4 CLEAR AGREEMENT. 5 (a) LIMITATIONS PRIOR TO ENTERING INTO NEGO- 6 TIATIONS.—No Federal funds may be authorized to be ap- 7 propriated or otherwise made available to enter into any 8 negotiation with the Government of Iran with respect to 9 an Iran nuclear agreement until the President certifies to 10 Congress that— 11 (1) the Government of China has ceased to in- 12 carcerate Uighur individuals in concentration camps 13 in the Xinjiang region; 14 (2) the Government of Iran has terminated— 15 (A) all agreements involving the transfer of 16 funds to such Government from China; and 17 (B) all agreements involving a strategic 18 military or security partnership with China; 19 (3) the Government of Iran has terminated all 20 ties and transfer of cash to Iranian proxy forces, in- 21 cluding Hamas; and 22 (4) the Government of Iran has verified the de- 23 struction of any and all chemical weapons, materials, 24 and infrastructure. 25 VerDate Sep 11 2014 05:36 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3465.IH H3465 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 3465 IH (b) REQUIREMENT FOR CONTENTS OF AGREE- 1 MENT.—No Federal funds may be authorized to be appro- 2 priated or otherwise made available for United States 3 entry into any Iran nuclear agreement, and the President 4 may not take any action (including in the form of an agen- 5 da, agreement, platform, or plan) to carry out the goals 6 of such an agreement, unless such agreement certifies the 7 destruction of any and all Iranian nuclear and missile ca- 8 pabilities, weapons, infrastructure, chemical weapons, and 9 offensive cyber activity. 10 (c) RATIFICATION REQUIRED.—Notwithstanding any 11 other provision of law, any Iran nuclear agreement shall 12 be deemed a treaty for purposes of the requirement of the 13 advice and consent of the Senate to ratification. The 14 President may not take any action (including in the form 15 of an agenda, agreement, platform, or plan) to carry out 16 the goals of such an agreement until the Senate has adopt- 17 ed a resolution of advice and consent to such ratification. 18 (d) REPORT REQUIRED.—The Secretary of State 19 shall submit to Congress, prior to the submission of a pro- 20 posed Iran nuclear agreement to the Senate for ratifica- 21 tion in accordance with subsection (c), a report setting 22 forth the manner and extent to which the negotiation and 23 terms of such proposed Iran nuclear agreement comply 24 with each limitation under this section. 25 VerDate Sep 11 2014 05:36 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H3465.IH H3465 kjohnson on DSK79L0C42PROD with BILLS 6 •HR 3465 IH SEC. 4. IRAN NUCLEAR AGREEMENT DEFINED. 1 In this Act, the term ‘‘Iran nuclear agreement’’ 2 means— 3 (1) the Joint Comprehensive Plan of Action, 4 signed at Vienna July 14, 2015, by Iran and by the 5 People’s Republic of China, France, Germany, the 6 Russian Federation, the United Kingdom and the 7 United States, with the High Representative of the 8 European Union for Foreign Affairs and Security 9 Policy, and all implementing materials and agree- 10 ments related to the Joint Comprehensive Plan of 11 Action; and 12 (2) any successor or other agreement exchang- 13 ing relief from international sanctions for restric- 14 tions on Iran’s nuclear program. 15 Æ VerDate Sep 11 2014 05:36 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6301 E:\BILLS\H3465.IH H3465 kjohnson on DSK79L0C42PROD with BILLS
