PUBLIC PLAYGROUNDS, PARKS, AND LIBRARIES. 1 (a) GRANT PROGRAM.—Part F of the Safe Drinking 2 Water Act (42 U.S.C. 300j–21 et seq.) is amended by add- 3 ing at the end the following: 4 ‘‘SEC. 1466. DRINKING WATER FOUNTAIN REPLACEMENT IN 5 PUBLIC PLAYGROUNDS, PARKS, AND LIBRAR- 6 IES. 7 ‘‘(a) ESTABLISHMENT.—Not later than 1 year after 8 the date of enactment of this section, the Administrator 9 shall establish a grant program to provide assistance to 10 States and municipalities for the replacement, in play- 11 grounds, parks, or libraries owned by (or libraries located 12 in) States or municipalities, of drinking water fountains, 13 including any lead service line that supplies the fountains, 14 manufactured prior to 2014. 15 ‘‘(b) USE OF FUNDS.—Funds awarded under the 16 grant program— 17 ‘‘(1) shall be used to pay the costs of replacing 18 drinking water fountains, in playgrounds, parks, or 19 libraries owned by (or libraries located in) a State 20 or municipality receiving such funds, with plumbing 21 endpoint devices certified by a third party certifi- 22 cation body accredited by the ANSI National Ac- 23 creditation Board as meeting the NSF/ANSI/CAN 24 61: Q≤1 standard, and, for endpoint devices con- 25 nected to premises plumbing, with filters installed at 26 VerDate Sep 11 2014 05:24 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3423.IH H3423 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 3423 IH the point where water is dispensed from the device 1 and is certified as compliant with NSF Inter- 2 national/American National Standards Institute 3 (ANSI) Standard 53-2017, Drinking Water Treat- 4 ment Units - Health Effects published by NSF 5 International, and incorporates an integral perform- 6 ance indication device as specified in section 6.1 of 7 NSF/ANSI standard 53-2017, or any more stringent 8 requirements adopted thereafter; 9 ‘‘(2) may be used to pay the costs of monitoring 10 and reporting of lead levels in the drinking water of 11 playgrounds, parks, and libraries owned by (or li- 12 braries located in) a State or municipality receiving 13 such funds, as determined appropriate by the Ad- 14 ministrator; and 15 ‘‘(3) shall be used to pay the cost of replacing 16 lead service lines servicing the water fountains. 17 ‘‘(c) PRIORITY.—In awarding funds under the grant 18 program, the Administrator shall give priority to— 19 ‘‘(1) projects and activities that benefit an un- 20 derserved community or a disadvantaged community; 21 and 22 ‘‘(2) applications for projects that replace pre- 23 1988 water fountains. 24 VerDate Sep 11 2014 05:24 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3423.IH H3423 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 3423 IH ‘‘(d) AUTHORIZATION OF APPROPRIATIONS.—There 1 is authorized to be appropriated to carry out this section— 2 ‘‘(1) $200,000,000 for fiscal year 2022; 3 ‘‘(2) $100,000,000 for fiscal year 2023; 4 ‘‘(3) $100,000,000 for fiscal year 2024; 5 ‘‘(4) $50,000,000 for fiscal year 2025; and 6 ‘‘(5) $50,000,000 for fiscal year 2026.’’. 7 (b) DEFINITIONS.—Section 1461 of the Safe Drink- 8 ing Water Act (42 U.S.C. 300j–21) is amended by adding 9 at the end the following: 10 ‘‘(8) DISADVANTAGED COMMUNITY.—The term 11 ‘disadvantaged community’ has the meaning given 12 such term in section 1452(d)(3). 13 ‘‘(9) PLAYGROUND OR PARK.—The term ‘play- 14 ground or park’ means an indoor or outdoor park, 15 building, site, or other facility, including any parking 16 lot appurtenant thereto, that is intended for recre- 17 ation purposes. 18 ‘‘(10) UNDERSERVED COMMUNITY.—The term 19 ‘underserved community’ has the meaning given 20 such term in section 1459A. 21 ‘‘(11) LIBRARY.—The term ‘library’ includes— 22 ‘‘(A) a public library; 23 ‘‘(B) a public elementary school or sec- 24 ondary school library; 25 VerDate Sep 11 2014 05:24 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3423.IH H3423 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 3423 IH ‘‘(C) a tribal library; 1 ‘‘(D) an academic library; 2 ‘‘(E) a research library, which, for pur- 3 poses of this subchapter means a library that— 4 ‘‘(i) makes publicly available library 5 services and materials suitable for schol- 6 arly research that are not otherwise avail- 7 able to the public; and 8 ‘‘(ii) is not an integral part of an in- 9 stitution of higher education; and 10 ‘‘(F) a private library or other special li- 11 brary, but only if the State in which the private 12 or special library is located determines that the 13 library should be considered a library for pur- 14 poses of this part.’’. 15 Æ VerDate Sep 11 2014 05:24 Jun 22, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H3423.IH H3423 kjohnson on DSK79L0C42PROD with BILLS
